RESOLUTION NO. 95-425 A RESOLUTION SETTING FORTH AN ABANDONMENT OF SIX 50-FOOT ROADWAYS RUNNING IN A NORTH-SOUTH DIRECTION BETWEEN ALBITE STREET AND AGATE STREET LOCATED IN SANTA CLAUS NO.2, SECTION 19, TOWNSmp 23 NORTH, RANGE 18 WEST, IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2, 1995, a public hearing was conducted to determine whether approval should be granted for an abandonment of the above described roadways, as requested by Jack Gaal, Borden-Gaal Contracting, Inc. of Boulder City, Nevada, and WHEREAS, Santa Claus No.2 is located west of Highway 93 and approximately 2 miles south of County Road 125 (Chloride Road). The subdivision is bounded by Colorado Road on the east, Roosevelt Road on the west, Albite Street on the north and Agate Street on the south. The site is accessed from Highway 93 via Colorado Road, then south to the site, and WHEREAS, Santa Claus No.2 consists of 55 five-acre parcels. At the time the subdivision was recorded the road network consisted of a dedicated road through the center of the subdivision running east to west and seven north to south dedicated roads. The owner of the subdivision granted additional easements on the north, south and west sides of the subdivision and two easements running north to south between the dedicated roadways. The exterior roads, the two granted easements running north to south and the central road running east to west have been bladed. The roads proposed for abandonment have not been improved, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action is not in conflict with the Mohave County General Plan, and the property is designated a Rural Development Area. c. All properties will maintain public access after the proposed action. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 1995, the Commission recommended APPROVAL for an Abandonment subject to the following: 1. The roadway running north to south from the north side of Lots 53 and 54 to the south side of Lots II and 12, except that portion of the 50-foot east to west roadway running through the center of the subdivision. . The roadway running north to south from the north side of Lots 55 and 56 to the south side of Lots 9 and 10, except that portion of the 50-foot east to west roadway running through the center of the subdivision. . The roadway running north to south from the north side of Lots 57 and 58 to the south side of Lots 7 and 8, except that portion of the 50-foot east to west roadway running through the center of the subdivision. . The roadway running north to south from the north side of Lots 59 and 60 to the south side of Lots 5 and 6, except that portion of the 50-foot east to west roadway running through the center of the subdivision. . The roadway running north to south from the north side of Lots 61 and 62 to the south side of Lots 3 and 4, except that portion of the 50-foot east to west roadway running through the center of the subdivision. . The roadway running north to south from the north side of Lots 63 and 64 to the south side of Lots I and 2, except that portion of the 50-foot east to west roadway running through the center of the subdivision. 2. That all granted roadways located in Santa Clause No. 2 be dedicated per separate instrument. 3. That 20- foot radius curves be dedicated per separate instrument at the intersection of all roadways within Santa Clause No.2. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 17 and September 24, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
