RESOLUTION NO. 95-422 A RESOLUTION SETTING FORTH A REZONE OF THE SOUTHEASTERLY FIVE ACRES OF PARCEL 13, CEDAR HILLS RANCHES, IN SECTION 29, TOWNSHIP 21 NORTH, RANGE 14 WEST, FROM C-2H110A (GENERAL COMMERCIAL HIGHWAY FRONTAGEITEN ACRE MINIMUM LOT SIZE) ZONE TO C-2H15A (GENERAL COMMERCIAL mGHWAY FRONTAGEIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Nellie Blake of Kingman, Arizona, and WHEREAS, this property is located north of Interstate 40 and west of the Blake Ranch Road interchange. The site is accessed from Interstate 40 via north of Blake Ranch Road to Kathy Road, then west on Kathy Road to the site. The site is on the southwestern comer of Kathy Road and Ty Road. The property is vacant and slopes slightly toward the west. The surrounding land uses consist of vacant land to the north and west, and Interstate 40 to the south. There is a truck stop with associated buildings to the east. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant proposes this zone change to allow a truck lubrication station. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2375B indicates the parcel described to be in Zone A, in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. -" . . PAGE 2 OF 3 BK 2630 PG 65~ FEE~95052151 RESOLUTION NO. 95-422 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C-2H15A (General Commercial Highway FrontagelFive Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The Board of Supervisors accepts the dedication of 45-foot radius curves at all dedicated roadway intersection points. 4. The Board of Supervisors accepts the granting of the eight feet adjacent to all dedicated roadways for Public Utilities Easements (PUEs). 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. The parcel shall have legal access. 7. The Parcel Plat shall show any surface drainage and FEMA flood zones. 8. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. The site plan must include a limited drainage report to mitigate any additional drainage created by this development. Also, paving requirements will be determined by the Public Works Department upon site plan submittal. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 11. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. '- . . RESOLUTION NO. 95-422 PAGE 3 OF 3 BK 2630 PG 655 FEE~95052151 Page 3 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . MOHA VE COUNTY BOARD OF SUPERVISORS NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 2,1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~~~& Pat Holt, Chairman
