AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 10/05/95 04:20P PAGE 1 OF 3 HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 95-417 A RESOLUTION SETTING FORTH A REZONE OF THE WESTERN PORTION OF PARCEL 516, STOCKTON lllLL RANCHES, UNIT 10, IN SECTION 18, TOWNSIDP 23 NORTH, RANGE 16 WEST, FROM A-RlI0A (AGRICULTURAL-RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-Rl5A, A-Rl3A AND A-RlIA (AGRICUL TURAL-RESIDENTIALlFIVE ACRE, THREE ACRE AND ONE ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2, 1995, a public hearing was conducted to determine whether a Rezone should be approved for the above described property as requested by Robert C. Goodblood of Kingman, Arizona, and WHEREAS, this property is located north of Kingman on Calle Cedral, west of Stockton Hill Road. The site is accessed from Stockton Hill Road, east on Calle Chavez, then south on A venida Ramirez, then approximately one mile east on Calle Cedral. The property is on the north side of Calle Cedral. The property has one home on the southwest comer fronting along Calle Cedral. The terrain is generally flat. The surrounding land uses are composed of undeveloped land and sparse home sites. Similar land divisions have occurred to the east and to the south of the property. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant proposes this zone change to allow development of additional residential lots on the property. The applicant proposes to divide the l6.71-acre (gross) property into three 5-plus-acre parcels. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. Washes shall not be obstructed, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan but not the Long Mountain Area Plan, adopted 6/1/92. The Area Plan restricts development to Rural ResidentiallFive Acre Minimum Lot Size. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action, e. The site has legal access. f. There are no significant environmental features affecting the site. . . . RESOLUTION NO. 95-417 Page 2 PAGE 2 OF 3 BK 2630 PG 6~2 FEE;950521~7 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The three parcels will be rezoned A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size). 2. The submittal and recordation ofa Parcel Plat prepared in accordance with Article 3,16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The Board of Supervisors accepts the dedication of the existing 3D-foot roadway easement along the north side of the property and the existing 3D-foot roadway easement along the west side of the property as roadway rights-of-way. In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. The Board of Supervisors accepts the granting of the eight feet adjacent to all rights-of-way as Public Utilities Easements (PUEs). 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 11. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification, This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ... .'-.. . . RESOLUTION NO. 95-417 Page 3 PAGE 3 OF 3 BK 2630 PG 6~3 FEE~950521~7 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, October 2, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
