RESOLUTION NO. 9S-416 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 3S-D, VOCK CANYON RANCHES, UNIT 1, IN SECTION 3S, TOWNSHIP 24 NORTH, RANGE 17 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIALrrmRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/ SA (AGRICUL TURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2, 1995, a public hearing was conducted to determine whether a Rezone should be approved for the above described property as requested by R. W. Holmquist & Associates of Kingman, Arizona, representing R.H. and Mona E. Albrecht of Bonita, California, and WHEREAS, the property is located north of Kingman, west of Stockton Hill Road. The property is accessed from Kingman via north on Stockton Hill Road to V ock Canyon Road, then west approximately one and three-quarter mile on V ock Canyon Road to the parceL The parcel is located on the north side of V ock Canyon Road. The property is vacant with gently rolling terrain. The surrounding land uses consist of grazing land with sparse home sites. Similar land divisions have occurred immediately to the south and west of the site. A wash, running west to east, crosses the property and should not be obstructed, and WHEREAS, the applicant proposes this zone change to allow development of four additional residential lots on the property. The applicant proposes to divide the 37.21-acre (net) property into three 5-plus-acre parcels, one 7-plus-acre parcel and one IO-plus-acre parceL The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. . . The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. . . The Board of Supervisors accepts the dedication ofthe existing 35-foot roadway easement known as V ock Canyon Road as a roadway right-of-way. Also, the Board of Supervisors accepts the dedication of the proposed 50-foot wide cul-de-sac with a 45 -foot radius terminus bulb to be named Travertine Lane, and the proposed 60-foot roadway to be named Travertine Drive on the property's eastern boundary as shown in Exhibit "A" as roadway rights-of-way. In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. The Board of Supervisors accepts the granting of the eight feet adjacent to all rights-of-way as Public Utilities Easements (PUEs). 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. II. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . .
