OF SECTION 25, TOWNSIllP 27 NORTH, RANGE 21 WEST, FORAN OFF-PREMISE SIGN IN A C-2H (GENERAL COMMERCIAL IDGHWAY FRONTAGE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2, 1995, a public hearing was conducted to determine whether a Zoning Use Permit should be approved for the above described property as requested by Horizon Outdoor Advertising Co., Chandler, Arizona, being represented by Michael Heedy, and WHEREAS, the applicant intends to place an off-premise advertising sign on this property. This property is located on the west side of Highway 93, approximately one-quarter mile north of the intersection of Highway 93 and White Hills Road. The site is accessed from Highway 93, and the property is vacant and relatively flat, and WHEREAS, a review of FEMA FIRM Panel #040058-1600B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the proposed location meets the zoning and spacing requirements for an off-premise sign. The Arizona Department of Transportation (ADOT) requires the off-premise sign to be located within 1,000 feet of an established commercial business. There is a cafe and bar located within 1000 feet north of the proposed sign location, and WHEREAS, this item has been previously considered by the commission without a decision being made, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. c. The neighboring area contains other like land uses similar to the above proposed action. d. The site has legal access. e. There are no significant environmental features affecting the site. - . . " RESOLUTION NO. 95-415 Page 2 PAGE 2 OF 2 BK 2633 PG 702 FEE~95053509 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 2. The applicant shall obtain the proper Arizona Department of Transportation (ADOT) permit and approval prior to erecting this sign. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained. 4. If construc~ion or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. 'This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 2,1995, DENIED this Zoning Use Permit for the following reasons: 1. The General Plan designates Highway 93 north of Pierce Ferry Road as a scenic vista. 2. The request is not consistent with the character of the area.
