RESOLUTION NO. 95-413 A RESOLUTION SETTING FORTH A REZONE OF LOT 5, BLOCK A, GOLDEN SAGE RANCHOS, UNIT 68, IN SECTION 27, TOWNSIllP 22 NORTH, RANGE 19 WEST, FROM A-R12A (AGRICUL TURAL-RESIDENTIALrrWO ACRE MINIMUM LOT SIZE) ZONE TO A-RlIA (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2, 1995, a public hearing was conducted to determine whether a Rezone should be approved for the above described property as requested by R. W. Holmquist & Associates of Kingman, Arizona, representing Billie Yeh of Bullhead City, Arizona, and WHEREAS, this property is located north of Highway 68 on Estrella Road between Zuni Drive and Chinle Drive. The site is on the west side of Estrella Road. There is a newly installed mobile home on the north half of the property. The terrain is generally flat. The surrounding land uses consist of undeveloped property and home sites. Similar land divisions have occurred in the area. There is a small wash running north to south near the rear of the property, and WHEREAS, the applicant proposes this zone change to allow development of an additional residential lot on the property. The applicant proposes to divide the 2.20-acre property into two 1.1 O-acre parcels. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2150B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. . . . RESOLUTION NO. 95-413 Page 2 PAGE 2 OF 2 BK 2630 PG 633 FEE~95052144 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-RlIA (Agricultural-Residential/One Acre Minimwn Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B ofthe Standard Specifications and Details is required. 3. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
