RESOLUTION NO. 95-410 A RESOLUTION SETTING FORTH A REZONE OF THE NW'I. OF PARCEL 67, SACRAMENTO VALLEY RANCHES, IN SECTION 18, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/ lOA (AGRICULTURAL-RESIDENTlALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/2A (AGRICULTURAL-RESIDENTIALrrWO ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by C.S.N.A. Surveying of Kingman, Arizona, representing David G. and Carole 1. Ryan of Long Beach, California, and WHEREAS, the property is located south of Highway 68 and north of Redwall Drive in Golden Valley. The site is accessed from Highway 68 via south on Teddy Roosevelt Road, then east on Collins Drive to Ligurta Road. The property is located at the southeast corner of Collins Drive and Ligurta Road. The property is vacant with no neighboring homes. The terrain is flat, sloping to the southeast. The surrounding land has similar lot splits. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant proposes this zone change for agricultural/residential development. The applicant proposes to divide the 9.99 acres into four two-plus-acre parcels. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-R/2A (Agricultural-Residentialffwo Acre Minimum Lot Size). 2, The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The Board of Supervisors accepts the dedication of the existing 30-foot easements known as Collins Drive and Ligurta Road adjacent to the parcels as roadway rights-of-way. An additional five feet of right-of-way is to be dedicated for Ligurta Road, increasing it to 35 feet along the property because it is classified as a collector mid-section line. In addition, 20-foot radius curves are required at all roadway intersection points adjacent to the property. Also, the Board of Supervisors accepts the dedication of a 50-foot wide cul-de-sac complete with a 45-foot radius bulb terminus. 4. The Board of Supervisors accepts the granting of the eight feet adjacent to the dedications for Public Utility Easements (PUEs). 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9, The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. II. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. ... -..... l .-...... . RESOLUTION NO. 95-410 . PAGE :3 OF:3 BK 2630 PG 626 Page 3 FEH950521H WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave Counly, Arizona, September 17, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave Counly Zoning Regulations. MORAVE COUNTY BOARD OF SUPERVISORS NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 2, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
