RESOLUTION NO. 95-407 A RESOLUTION SETTING FORTH A REZONE OF THE Wy, SWY.. SWY.. NWY.. OF SECTION II AND THAT PORTION OF THE WEST 1000 FEET OF THE NY, SWY.. OF SECTION 11 LYING NORTH OF THE NORTH RIGHT-OF-WAY LINE OF HIGHWAY 68, TOWNSHIP 21 NORTH, RANGE 20 WEST, FROM A-R/IOA (AGRICULTURAL-RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/3A AND A-R/2A(AGRICULTURAL-RESIDENTIALrrHREE ACRE AND TWO ACRE MINIMUM LOT SIZE) ZONES, IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Branscor Development Company, Defined Pension Plan, Stephen Woloshim, Trustee of Scottsdale, Arizona, and WHEREAS, this property is located north of Highway 68 in the Union Pass area west of the Golden Valley Area and east of the Bullhead City Area approximately half way between the II and 12 mile markers on Highway 68. The site is accessed from Highway 68. The property is vacant. The terrain is moderately hilly and the surrounding area is vacant, except for one residence to the west. There are no significant environmental features affecting the property, and WHEREAS, the applicant proposes this zone change to bring these two lots into conformance with zoning regulations so a residence can be built on them. The property was divided by deed prior to the implementation of the General Plan. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2300B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property does not comply with the Mohave County General Plan, but the property was split prior to the plan's adoption. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. . .- . . RESOLUTION NO. 95-407 Page 2 PAGE 2 OF 2 BK 2630 PG 619 FEEt95052138 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The parcel defined as the WYZ SWY4 SWY4 NWY4 of Section 11 will be rezoned as A-R/3A (Agricultural-ResidentiallThree Acre Minimum Lot Size) and the parcel defined as that portion of the west 1000 feet of the NYz SWY4 of Section II lying north of Highway 68 will be rezoned A-R/2A (Agricultural-Residential/Two Acre Minimum Lot Size). 2. The applicant will provide an ingress and egress (I&E) easement to the parcel defined as the WYZ SWY4 SWY4 NWY4 of Section 11 along the western boundary of the parcel defined as that portion of the west 1000 feet of the NYz SWY4 of Section 11 lying north of Highway 68. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained. 4. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 5. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting on Monday, October 2, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
