RESOLUTION NO. 95-403
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR AZTEC VILLAS, TRACT 4065, BEING A PORTION
OF THE E'h SEJ4 NWJ4 OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE
SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October
2, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time as requested by representative G. Kelly Grier of Stovall Engineers, Inc. of Bullhead City, Arizona,
and
WHEREAS, the subdivision is located east of Highway 95, north of Aztec Road and west of Calle
Del Media. The site is accessed from Highway 95 via Aztec Road, then east to the site, and
WHEREAS, the surrounding land uses consist of single-family residential subdivisions and vacant
land, and
WHEREAS, the Preliminary Plan depicts 20 acres subdivided into 67 single-family lots, ranging
in size from 8,000 square feet to 17,000 square feet. The engineer of record for the subdivision is Stovall
Engineers, Inc. of Bullhead City, Arizona, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on March 9, 1992, per BOS Resolution No. 92-66. The first Extension of Time was granted
on June 6,1994, per BOS Resolution No. 94-167. The Final Plat approval was granted on July 6,1992, per
BOS Resolution No. 92-245, and
WHEREAS, a letter dated June 7,1995, from Stovall Engineers quotes the following: "Due to
difficulties in obtaining right-of. way on Calle del Media and lack of availability of sewer for this project,
the owner decided to do the project in Phases. A Phasing Plan was submitted to the County on June 20,
1994. At this time a Final Plat for Phase A was also submitted and has been in the County review process.
We are currently working on the resolution of comments from the Public Works Department. The first
phase would be on dry sewer, while subsequent phases would be hook[ed]-up to the sewer system, The
original Final approval was based on individual septic systems. Per our telephone conversation this
afternoon, I offer the following dilemma: The original Final Plat has been approved, and there has been an
unresolved question, with a previous staff member, of whether or not a Time Extension would be dated from
the Preliminary, or from the Final Approval. Last year, we submitted and received approval for an
Extension of Time in June (coinciding with the submittal of the Phased Final Plat), however the expiration
date in the resolution was set for March 9, 1995", and

WHEREAS, because the Final Plat for this tract was never recorded and the developer has submitted
a new Final Plat and a phasing plan, an Extension of Time for the approved Preliminary Plan is required.
The date of extension is based on the date of the original Preliminary approval, which is March 9, and
WHEREAS, the Mohave County Public Works Department requires compliance with current
requirements, compatibility with drainage and circulation patterns of recent nearby development, and
WHEREAS, this will be the second Extension of Time, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
designated as an Urban Development Area.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses.
d. This request for an extension complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 13, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the
following:
I. Compliance with all conditions ofBOS Resolution Nos. 92-66 and 94-167.
2. This Extension of Time will be in effect until March 9,1996.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, October 2, 1995, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
