RESOLUTION NO. 95-402
A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 94-167
WHICH APPROVED AN EXTENSION OF TIME FOR THE REVISED PRELIMINARY
SUBDIVISION PLAN FOR AZTEC VILLAS, TRACT 4065, BEING A PORTION OF THE EY. SEv,.
NWv,. OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE
VALLEY AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October
2, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time for the Revised Preliminary Subdivision Plan for Aztec Villas, Tract 4065, and
WHEREAS, the original resolution did not indicate that this property is in the NWv,. of Section 23.
The only change from the original resolution is in the Legal Description, and
WHEREAS, the owner/developer of this project is the Counsel Corporation, John K. Hoover,
President, of Orange, California. The engineering fIrm responsible for plan preparation and drainage study
is Stovall Engineers Inc., Bullhead City, Arizona, and
WHEREAS, the proposed subdivision is located one-half mile east of Highway 95 between the
highway and Mountain View Road and between Camp Mohave and El Rodeo Roads. Access is provided
to this site from Highway 95 via Aztec Road, and
WHEREAS, the preliminary subdivision plan depicts 20 acres divided into 67 lots having a
minimum lot size of 8,000 square feet and a maximum lot size of 17,000 square feet for an overall density
of 3.4 lots per acre, and
WHEREAS, water will be supplied by the Bermuda Water Company, electric power by Mohave
Electric Cooperative, and telephone service by Citizens Utilities Company. Sewage disposal will be via
individual on-site systems. Solid waste disposal will be provided by private contractor to the Mohave
Valley Landfill, and fire protection by \he Fort Mohave Mesa Fire Department, and
WHEREAS, Planning and Zoning is in receipt of a letter dated May 6, 1994, written by Robert
Johnson, Mohave Valley Irrigation and Drainage District, addressed to Denise Stovall-Burton. This letter
rejected the request for reallocation of water and specified that once a developer has received a water set
aside and the time limit has expired, \he developer must post his assurances with \he County, with a copy
to the District, before a new Water Adequacy Statement can be granted, and

WHEREAS, the granting of the request for an Extension of Time will allow the developer time to
complete his Final Plat whereupon assurances can be posted and the required Water Adequacy Statement
can be granted by the Mohave Valley irrigation and Drainage District, and .
WHEREAS, the Article III, Section 3.10, states, "Upon application to the Commission and prior
to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board if
the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating
to the plat shall be terminated", and
WHEREAS, in a letter dated March 1,1994, Ms. G. Kelly Grier, Stovall Engineers Inc., states: "On
behalf of the owner/developer of Aztec Villas, Tract 4065, I respectfully request an Extension of Time in
order to proceed with the processing of this project. The Revised Preliminary Plan was approved by the
Mohave County Board of Supervisors on March 9, 1992, Resolution No. 92-66. The Final Plat for this
project was approved by the Board of Supervisors on July 6, 1992, Resolution No. 92-245, and
"This is the first request for an Extension of Time on this project. A cheque, made payable to
Mohave County Planning and Zoning Department, in the amount of $200.00, is enclosed as
application fee.
"The owner/developer intends to submit a request to the Planning and Zoning Commission and the
Board of Supervisors in order to phase this project, and will be requesting an amendment to
complete the project in six (6) phases. A Phasing Plan and a revised Final Plat for Phase "A" is
being prepared and will be submitted with Improvement Plans and all required documents, pending
approval of this time extension."
WHEREAS, the preliminary plan for this tract was approved by the Mohave County Board of
Supervisors on March 9, 1992, via BOS Resolution No. 92-66. This will be the first Extension of Time, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 13, 1995, the Commission recommended APPROVAL for an amendment subject to the
following:
1. Compliance with all conditions ofBOS Resolution No. 92-66.
2. This Extension of Time will be in effect until March 9, 1995.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, October 2, 1995, APPROVED this Amendment to BOS Resolution No. 94-167 as
recommended by the Mohave County Planning and Zoning Commission and outlined herein. .
