MOHAVE COUHTY RECORDER 10/05/95 04:12P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 95-400 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 28, SUNLAKE VILLAGE, TRACT 3700-A (TENTATIVE), IN A PORTION OF SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, FOR A MODEL HOME SALES OFFICE IN A R-O!7M (SINGLE- F AMIL Y RESIDENTIAL/MOBILE HOMES PROHIBITED/SEVEN THOUSAND SQUARE FEET MINIMUM LOT SIZE) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 2,1995, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Scott F. Ward, representing the SUNLAKE VILLAGE Subdivision of Lake Havasu City, Arizona, and WHEREAS, this property is located west of Highway 95 and between the Lake Havasu City Limits and Lake Drive. The site is accessed from Highway 95 via west on Jacob Row to the site. The site is located on the south side of Jacob Row between Frederick Way and Frederick Lane, The property has been graded and has a home under construction on it. There are two houses under construction on the two lots to the west; the remaining lots in the tract are vacant. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant proposes this Zoning Use Permit to allow a sales office in a model home for the Sunlake Village Subdivision. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-31 lOB indicates the parcel described to be in Zone AO, in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. - . . . RESOLUTION NO. 95-400 Page 2 PAGE 2 OF 2 BK 2630 PG 598 FEE~95052131 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. The Zoning Use Permit will expire upon the sale of the model home. 2. The sale of homes/lots from this office will be limited only to homes/lots within the proposed Sunlake Village, Tract 3700-A (Tentative), Subdivision. 3. The Zoning Use Permit will become effective upon the recordation of the final plat for the Sunlake Village, Tract 3700-A (Tentative), Subdivision. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained, 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September 15, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 2, 1995, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
