CI Al RECORDS OF MOHAVE roUNTY, AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 12/07/95 12:59P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS REORDIHG FEE 0.00 RESOLUTION NO. 95-502 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL 2-B, AS SHOWN ON PARCEL PLAT BOOK 9, PAGE 57, RECORDED FEBRUARY 10, 1995, IN THE SEY- SEY- OF SECTION 29, TOWNSHIP 22 NORTH, RANGE 16 WEST, FOR A RESIDENCE IN A C-MO/5A (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGEIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE KINGMAN AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 4, 1995, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by David H. and Susan M. Roe of Kingman, Arizona, and WHEREAS, this property is located north of Northern Avenue and west of Castle Rock Road in the north Kingman area. The site is accessed from Castle Rock Road via west on Northfield Avenue to the site. The property is at the west terminus ofNorthfield Avenue about 600 feet west of Castle Rock Road. The property is presently being used as open storage for the applicant's mobile home installation equipment. The surrounding uses consist of the Citizens Utilities complex to the south, a vehicle repair shop and septic tank service to the east, and the remaining surrounding property is vacant. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant proposes this Zoning Use Permit to put a residence on this commercial property. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2I65C indicates the parcel described to be in Zone AH, in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site except the noted special flood hazard area. RESOLUTION NO. 95-502 Page 2 . . WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 8, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit (ZUP) is for a residence in a commercial zone and the activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to the approval of permits. A limited drainage report is required to outline a method to mitigate the on-site drainage affecting this site. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 4, 1995, APPROVED this Zoning Use Permit as recommended by tile Mohave County Planning and Zoning Commission and outlined herein.
