MOHAVE COUNTY RECORDER 12/07/95 12:59P PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 95-501 A RESOLUTION SETTING FORTH A REZONE OF PARCELS 2-A AND 2-B, AS SHOWN ON PARCEL PLAT BOOK 9, PAGE 57, RECORDED FEBRUARY 10, 1995, IN THE EYz SEY- OF SECTION 29, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM C-M0/36A (COMMERCIAL- MANUFACTURING/OPEN LOT STORAGEITHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO C-MO/5A (COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 4, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by David H. and Susan M. Roe of Kingman, Arizona, and WHEREAS, this property is located north of North em Avenue and west of Castle Rock Road in the north Kingman area. The site is accessed from Northern Avenue via north on Castle Rock Road to the site. The property is on the west side of Castle Rock Road approximately one-quarter mile north of Northern Avenue. The property is presently being used as open storage for the applicant's mobile home installation equipment. The surrounding uses consist of the Citizens Utilities complex, a vehicle repair shop and septic tank service to the south, homes and several small business to the east, and the remaining surrounding property is vacant. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant proposes this zone change to correct the zoning for this property. The property was rezoned to C-MO/36A via P&ZC Resolution No. 86-99 on August 4, 1986. The 40.94-acre parcel was split with a parcel plat on February 10, 1995 without rezoning, the applicant not realizing that a rezone was necessary. The applicant split the 40.94-acre parcel into two parcels of7.l6 and 33.82 acres. The 7.I6-acre parcel will be used as a storage area for their mobile home installation business and the applicant will place a residence on it. The remaining 33.82 acres will be used for future development. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2I65C indicates the parcel described to be in Zone AH, in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. RESOLUTION NO. 95-501 Page 2 '. . . e. The site has legal access. f. There are no significant environmental features affecting the site except the noted special flood hazard area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned CoMO/SA (Commercial-Manufacturing/Open Lot StoragelFive Acre Minimum Lot Size). 2. A Zoning Use Permit (ZUP) is required for the placement of a residence on this property with this zoning. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits for the 7.l6-acre parcel. The Section 27.P requirements will be accomplished upon development of the 33.82-acre parcel. A limited drainage report is required to outline a method to mitigate the on-site drainage affecting this site. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. The rezone shall not become effective until at least 30 days after fmal approval of the change in classification by the Board of Supervisors, as per ARS lI-829E. 6. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6,11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 4, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
