WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 4, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by North Star Steel Company of Minneapolis, Minnesota, being represented by William D. Goodale, Executive Director, Mohave County Economic Development Authority of Kingman, Arizona, and WHEREAS, this property is located northwest of Oatman RoadlRoute 66 and north of the McConnicolInterstate 40 Interchange. The site is accessed from Interstate 40 via north on the McConnico exit to Oatman Road, then northeast on Oatman Road to the site. The site is located on the north side of Oatman Road approximately one-half mile from the intersection of the McConnico exit road and Oatman Road. The property is vacant and the terrain is sloping slightly to the southwest. The surrounding land is vacant. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant proposes this zone change to allow for a trucking company independent of the North Star Steel Company. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the Mohave County Public Works Department requests concurrence from the Arizona Department of Transportation (ADOT) for the method of accessing State Highway 66. Also, the developer should investigate the applicability of the Army Corps of Engineers' 401 and 404 permits for Environmental Impacts and Flood Impacts, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. RESOLUTION NO. 95-499 Page 2 . . e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. This parcel will be rezoned C-2H (General Commercial Highway Frontage) and is identified as a IO-acre parcel ofland measuring 660.00 feet by 670.15 feet, located approximately 2280 feet northeast of the southwest corner of Section 5 on the northwest side of the Oatman Road right-of-way. 2. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. In addition, a drainage report will have to be submitted. Also, if the grading is in excess of 200 cubic yards, a grading permit is required. 3. The appropriate zoning, building, environmental and floodplain permits be obtained prior to construction. 4. The rezone shall not become effective until at least 30 days after fmal approval of the change in classification by the Board of Supervisors, as per ARS II-829E. 5. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
