A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT ON THE N'Iz OF SECTION 14,
TOWNSHIP 19 NORTH, RANGE 18 WEST, EXCEPT THE NORTH 42 FEET, FOR A NATURAL
GAS-FIRED POWERED GENERATION STATION IN A M-X (HEAVY MANUFACTURING)
ZONE, IN THE MORA YE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
4,1995, a public hearing was conducted to determine whether a Specific Use Permit should be granted for
the above described property as requested by Bruce A. Mitchell, P.E., Right-of-Way Supervisor, Citizens
Utilities Company, Electric Division, Kingman, Arizona, and
WHEREAS, this property is located west of Interstate 40, south of Yucca Drive between Yuma
Road and Centenial Road. The site is accessed from Interstate 40 via the Griffith Road Interchange, then
west on Griffith Road to Apache Road, then north on Apache Road to Yucca Drive, then west on Yucca
Drive to the site. The site is on the south side of Yucca Drive between Yuma Road and Centenial Road. The
property is vacant and relatively flat with the terrain is sloping slightly to the southwest. The surrounding
land use consists of vacant rangeland. There are no significant drainage patterns that cross the property, and
WHEREAS, the applicant proposes this Specific Use Permit for a natural gas-fired powered
generation station on this site. The Mohave County General Plan designates this area as an Urban
Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2600B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the Mohave County Public Works Department requests that the access road to the site
be improved to minimum County Standards. Also, the developer should investigate the applicability of the
Army Corps of Engineers' 401 and 404 permits for Environmental Impacts and Flood Impacts, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The site has legal access.
e. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 8, 1995, the Commission recommended APPROVAL for a Specific Use Permit subject to the
following:
1. This Specific Use Permit is intended for a natural gas-fired powered generation station and
activities related thereto; any new use will require another Specific Use Permit.
2. The Specific Use Permit will commence upon the effective date of the rezone.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits. In addition, a drainage report will have to be submitted. Also,
depending upon the amount of grading contemplated, an engineered grading permit may be
required.
4. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
5. Approval of a Specific Use Permit, with such conditions and restrictions as the Board of
Supervisors may impose, shall be valid for two (2) years, in which time construction on the
project shall commence or the use authorized shall be initiated. Prior to expiration of the
approval, the developer may request an Extension of Time from the Commission to initiate
the project, and the Commission shall recommend to the Board an action based upon a
finding of substantial grounds of which to grant such an Extension of Time up to one (1)
year.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting
on Monday, December 4, 1995, APPROVED this Specific Use Permit as recommended by the Mohave
Coun~\\~d Zoning Commission and outlined herein.
