A RESOLUTION SETTING FORTH A REZONE OF PARCEL 36-C, LAZY Y -U RANCH, PRASE
I AMENDED, IN SECTION 10, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A-R/14A
(AGRICUL TURAL-RESIDENTIAL/FOURTEEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A
(AGRICUL TURAL-RESIDENTIAL/FIYE ACRE MINIMUM LOT SIZE) ZONE, IN THE
MOHA YE COUNTY GENERAL AREA, MOHA YE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
4, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by the owners, Ronald and Gail Linn of Kingman, Arizona, and
WHEREAS, the site is accessed from Lazy YoU Road to Buckboard Trail to Pack String Lane to
the site. The property has a house on it. The surrounding land uses consist of similar lot splits. The terrain
is very steep and mountainous. There are no significant drainage patterns that cross the property, and
WHEREAS, the applicant proposes this zone change to allow residential development. The
applicant proposes to divide the I 4.78-acre parcel into two 7.39-acre parcels. The Mohave County General
Plan designates this area as a Rural Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2350C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect on the property complies with the Mohave County
General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. Extremely steep and mountainous terrain are significant environmental features affecting the
site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:

1. The parcels will be zoned A-Rl5A (Agricultural-Residential/Five Acre Minimum Lot Sizes).
2. The submittal and recordation ofa Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
is required. An adequate building site will be identified on the Parcel Plat.
3. Adequate Ingress and Egress (I&E) will have to be provided for all proposed parcels.
NOTE: Section 6.4-11 of the Mohave County Subdivision and Road Maintenance
Regulations states, "Road and street grades shall be limited to a maximum of sixteen percent
(16%) for paved roadways and a maximum of twelve percent (12%) for thoroughfares and
gravel roadways."
4. The roadway easement centerline will be monumented beneath the bladed road surface at all
easement angle points and coinciding parcel corners.
5. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
6. Each parcel shall have legal access and identify access on the Parcel Plat.
7. The Parcel Plat shall show any surface drainage and FEMA flood zones.
8. Roadways and/or driveways shall not block any washes and must be constructed to the
satisfaction of the County Engineer.
9. The appropriate zoning, building, environmental and floodplain permits be obtained prior
to any development. These permits will not be issued until Parcel Plat recordation. NOTE:
Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental
Health or ADEQ. Alternative waste treatment systems may be required for these lots.
10. The rezone shall not become effective until at least 30 days after final Board of Supervisor'
approval for the change in classification, as per ARS 11-829E.
11. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board (after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a public hearing to grant an extension,
determine compliance with the schedule for development, or cause the property to revert to
its former zoning classification. This action is in accordance with Arizona Revised Statutes
Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLYED, that the Board of Supervisors, at their regular meeting
on Monday, December 4, 1995, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
