WHEREAS, following are the Findings of Fact for the above captioned item: WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 4, 1995, a public hearing was conducted to determine whether approval should be granted for an abandonment of the 8-foot Public Utilities and Drainage Easements (PUEs and DEs) located at the rear of Lots 2003 and 2004 as requested by Victor Riccardi, Jr., the Fire Chief of Valle Vista Fire District, Kingman, Arizona, and WHEREAS, the proposed abandonment site is located in the Valle Vista Subdivision. The site is accessed from Highway 66 north of Kingman to Concho Drive, then west on Mesa Vista Drive approximately 92 feet to the proposed abandonment, and WHEREAS, there is a fire station located east of the proposed abandonment. There are no . significant drainage patterns that cross the property, and WHEREAS, the applicant proposes this abandonment to allow the building expansion of the existing fire station, and WHEREAS, a review ofFEMA FIRM Panel #040058-2000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, there are no utility lines within the easement and drainage does not flow through the easement, and. a. All notices have been advertised and posted according to regulations. b. The proposed action is not in conflict with the Mohave County General plan, and the property is designated an Urban Development Zone. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. '" :J> . . RESOLUTION NO. 95-492 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 8, 1995, the Commission recommended APPROVAL for an Abandonment subject to the following: I. The Board of Supervisors accepts the granting of a 10-foot existing utility easement along the South boundary of the North lot line of Lot 2004 to allow continuity of utility access. In addition, an 8-foot front lot line public utility easement will be granted adjacent to all road rights-of-way. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting on Monday, December 4, 1995, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
