RESOLUTION NO. 95-491
A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE 8-FOOT PUBLIC UTILITIES
AND DRAINAGE EASEMENT (pUE AND DE) LOCATED AT THE REAR OF LOTS 2009, 2010,
2024 AND 2025, OF VALLE VISTA ESTATES, UNIT TWO, TRACT 1200, IN SECTION 3,
TOWNSHIP 23 NORTH, RANGE 15 WEST, IN THE VALLE VISTA PORTION OF THE
MOHA YE COUNTY GENERAL AREA, MOHA YE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
4, 1995, a public hearing was conducted to determine whether approval should be granted for an
Abandonment of the 8-foot Public Utilities and Drainage (pUEs and DEs) Easements located at the rear of
Lots 2009, 2010, 2024, and 2025 as requested by Thomas Erickson of Kingman, Arizona, and
WHEREAS, the proposed abandonment site is located in theValle Vista Subdivision. The property
is accessed from Highway 66 north of Kingman to Concho Drive, then west on Mesa Vista approximately
100 feet to the site on the west side, and
WHEREAS, there is one home on Lot 2024 with one other home south of the site. The remaining
lots are vacant. There are no significant drainage patterns that cross the property, and
WHEREAS, the applicant proposes this abandonment to allow a sales pavilion and community use
area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2000B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, there are no utility lines within the easement and drainage does not flow through the
easement, and
WHEREAS, following are the Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations,
b. The proposed action is not in conflict with the Mohave County General plan, and the
property is designated an Urban Development Area (UDA).
c. The site is adequate for the action intended and the use is consistent with the neighborhood.
e. The site has legal access,
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 8, 1995, the Commission recommended APPROVAL for an Abandonment subject to the
following:
1. The Board of Supervisors accepts the granting of the 8-foot front lot line adjacent to all road
rights-of-way as Public Utility Easements. In addition, 10-foot utility easements will be
granted along the south side lot lines of Lots 2011 and 2024.
2. Lots 2009, 2010, 2024, and 2025 will be combined into one lot.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting
on Monday, December 4,1995, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
