RESOLUTION NO. 95-490
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 411, VALLE. VISTA,
TRACT 1192, IN SECTION 15, TOWNSHIP 23 NORTH, RANGE 15 WEST, FOR AN OFF-
PREMISE SIGN IN A SD/C-2 (SPECIAL DEYELOPMENT/GENERAL COMMERCIAL) ZONE,
IN THE VALLE VISTA PORTION OF THE MORAVE COUNTY GENERAL AREA, MOHA YE
COUNTY, ARIZONA.
WHEREAS, the following described Findings of Fact are for the above captioned item:
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
4,1995, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above described property as requested by R Group Enterprises, Inc., of Kingman, Arizona, and
WHEREAS, this property is located west of Highway 66 and north of Concho Drive. The site is
accessed from Highway 66 via northwest on Concho Drive to the site. The property is on the northeast side
of Concho Drive between Cochise Circle and Ironwood Drive. The property is vacant except for a four-foot
by six-foot (4' x 6') off-premise advertising sign on this property. The surrounding property is vacant except
for a realty office to the southeast. The property is flat and slopes slightly toward the southwest. There are
no significant drainage patterns that cross the property, and
WHEREAS, the applicant proposes this Zoning Use Permit to allow an off-premise sign to be
placed on this property. The Mohave County General Plan designates this area as an Urban Development
Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, previously the Planning and Zoning Commission has denied a Zoning Use Permit
(ZUP) application for an off-premise sign in this area, and
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended but the use is not consistent with the surrounding
neighborhood.
d. The sign is located in a commercial area.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 8, 1995, the Commission recommended DENIAL for a Zoning Use Permit based upon the
following:
1. Mohave County Zoning Regulations, Section 31-8-D, Off-Premise Signs, states that "It is
the policy of the Board of Supervisors and Planning and Zoning Commission of Mohave
County to permit off-premise signs to be located in viable commercial areas and to
discourage the rezoning of lots and parcels for the sole purpose of installing off-premise
signs."

2. It appears that the placement of the proposed sign is within a 20-foot beautification easement
which exists along the front lot line of this property.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting
on Monday, December 4,1995, DENIED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
