(. .., l RESOLUTION NO. 95-482 ~'~S.!...c \t A RESOLUTION SETTING FORTH A REZONE OF THE SYZ OF PARCEL 68, IN SECTION 18, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/I0A (AGRICUL TURAL-RESIDENTIAU TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/4A (AGRICUL TURAL-RESIDENTIALlFOUR ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. (1 '-? of /,0 i ( <~; WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 4, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by t)1e owner, Ralph L. Hushbeck of Laughlin, Nevada, and a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, this property is located south of Highway 68. The site is accessed from Highway 68 via south on Colorado Road to the property at the comer of Redwall Drive and Colorado Road. The property is vacant. The surrounding land use consists of vacant land. There are no significant drainage. patterns that cross the property. The terrain is sloping slightly to the southeast, and WHEREAS, the applicant proposes this zone change to allow residential development. The applicant proposes to divide the 17.34 (net) acres into four, 4.34 (net) acre parcels. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 8, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: . . .~ . " . . RESOLUTION NO. 95-482 Page 2 I. These parcels will be rezoned A-R/4A (Agricultural-ResidentiallFour Acre Minimum Lot Size). 2. The submittal and recordation ofa Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The Board of Supervisors accepts the dedication of the existing 50-foot roadway easements known as Colorado Road and Redwall Drive and the existing 30-foot roadway easement known as Lochiel Road as road rights-of-way. In addition, 8-foot radius curves are required at all dedicated roadway intersection points. 4. The Board of Supervisors accepts the granting of the eight feet adjacent to all rights-of-way as Public Utility Easements (PUEs), 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10, The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS I I -829E. 11. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title I I, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. RESOLUTION NO. 95-482 Page 3 NOW THEREFORE BE IT RESOLYED, that the Board of Supervisors, at their regular meeting on Monday, December 4, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
