RESOLUTION NO. 95-480
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE SWY-i AND THE
EASTERLY 20 FEET OF THE NWY-i OF LOT 8, LE CLAIR SUBDIVISION, IN SECTION 15,
TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A DOG KENNEL IN AN A-R
(AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHA YE V ALLEY AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, the following described Findings of Fact are for the above captioned item:
WHEREAS, at the regular meeting of the MOhave County Board of Supervisors held on December
4,1995, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above described property as requested by Heather McMahon of Bullhead City, Arizona, and
WHEREAS, this property is located west of Highway 95 and south of Bullhead City. The site is
accessed from Highway 95 via west on Valencia Road to the site. The site is located south of Valencia Road
and west of Cavalry Road. The property has a residence with a garage on it. There are no significant
drainage patterns that cross the property, and
WHEREAS, the applicant proposes this Zoning Use Permit to allow an indoor kennel business using
the existing garage. The Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review ofFEMA FIRM Panel #040058-2435D indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 8, 1995, the Commission recommended DENIAL for a Zoning Use Permit based upon the
following;
1. The numerous objections from the neighborhood, and a kennel is not an appropriate use in
an Urban Development Area.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting
on Monday, December 4, 1995, DENIED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
