RESOLUTION NO. 95-476 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 92-255 WHICH APPROVED THE REZONING OF THE NW'/. SW'I. OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS COURTNEY PARK EAST, TRACT 4147, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO R-M/6M (MUL TIPLE- FAMILY RESIDENTIAL/SIX THOUSAND SQUARE FEET MINIMUM LOT SIZE) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. 'WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 4, 1995, a public hearing was conducted to determine whether approval should be granted for an amendment to BOS Resolution No. 92-255 as requested by Stovall Engineers of Mohave Valley, agent for the owner, Dennis Gootrad, and WHEREAS, the subject property is located two miles south of Bullhead City's city limit, and is accessed from Highway 95 via Aztec Road, one-quarter mile east at the southeast comer of the intersection of the proposed Mesa Villas Drive and Aztec Drive, and WHEREAS, BOS Resolution No. 92-255, approved by the Board of Supervisors on August 3, 1992, set forth the rezoning of the NWV. SW'/., Section 23, Township 19 North, Range 22 West, also known as Courtney Park East, Tract 4147, with conditions. Condition number 8 states "Submittal of a site plan for the open space areas and above mentioned amenities be submitted before recordation of this tract. If phased the open space area and amenities shall be constructed with the first phase." The amenities referred to were recreational facilities, other than pools, and a ramada with picnic tables, proper fencing and limited access, and WHEREAS, the agent states the reason for the amendment, as quoted from the agent's letter of request dated October 6, 1995, "The site plan was submitted with the Final Plat for Phase A, which has been recorded and constructed, with the exception of the amenities and improvements to the Open Space parcel. It is believed that if the landscaping, play equipment, picnic tables and barbecues are placed on this site, at this time, that there would be problems of vandalism and liability; however, if the improvements and amenities are completed with the construction of Phase B, there would be more physical protection for the site and the amenities...", and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. . . RESOLUTION NO. 95-476 Page 2 FEE~9600190 PAGE 2 OF 3 BK 2669 PG 443 b, The proposed action and the effect on the property are in concurrence with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features or problems affecting the site. f. The area contains other like land uses similar to the above proposed action. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 8, 1995, the Commission recommended APPROVAL of the amendment to BOS Resolution No. 92-255 subject to the following: 1. Continued compliance with the remaining conditions ofBOS Resolution No. 92-255. 2. Condition number 8 ofBOS Resolution No. 92-255 shall read: "Submittal of a site plan for the open space areas and above mentioned amenities shall be submitted before recordation of this tract. If the tract is phased, the open space area and amenities shall be constructed with the SECOND phase." 3. Condition number 10 to be added to BOS Resolution No. 92-255 shall read: "The rear setback shall be measured from the rear property line as shown on 'Exhibit A'. " 4. The screening wall be constructed with the second phase. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 19, 1995, and posted November 17, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting on Monday, December 4, 1995, APPROVED this Amendment to BOS Resolution No. 92-255 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
