RESOLUTION NO, 95-463
A RESOLUTION SETTING FORTH A REZONE OF LOTS 51 AND 52, BLOCK CC, LAKE
MOHA YE COUNTRY CLUB ESTATES, UNIT 3, AMENDED, IN SECTION 31, TOWNSHIP 22
NORTH, RANGE 16 WEST, FROM R-1120M (SINGLE-FAMILY RESIDENTIALffWENTY
THOUSAND SQUARE FEET MINIMUM LOT SIZE) ZONE TO A-R (AGRICULTURAL-
RESIDENTIAL) ZONE, IN THE KINGMAN AREA, MOHA YE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
6, 1995, a public hearing was conducted to determine whether a Rezone should be granted for the above
described property as requested by Walter F, Evans and Virginia V. Vertuli of Kingman, Arizona, and
WHEREAS, this property is located east of Stockton Hill Road, between Gordon Drive and
Northern Avenue in the Butler Area, north of Kingman. The site is accessed from Stockton Hill Road via
east on Sierra Vista Avenue to the site. The property is located on the southeast comer of North Adams
Street and Sierra Vista Avenue. The property has a residence on it and is flat, sloping slightly to the east
toward Highway 66. The property west of North Adams Street is zoned A-R (AgriculturaJ-Residential) and
does allow horses and cows to be maintained for private use, and
WHEREAS, the applicants propose to rezone the two lots, which were joined through the Mohave
County Assessor's Office, so as to maintain a horse for their private use. They have filed a new Joint
Tenancy Deed combining the two lots. The Mohave County General Plan designates this area as an Urban
Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect on the property are not in conformance with the Mohave
County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain; the property to the west is zoned A-R (Agricultural-Residential).
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 11, 1995, the Commission recommended DENIAL for a Rezone based upon the following:
1. This will constitute spot zoning and is in conflict with the General Plan.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, October 22,1995, and posted October 20, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting
on Monday, November 6,1995, DENIED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
