OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 95-462 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 14, LAKE MOHA VE COMMERCIAL CENTER, IN SECTION 2, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR GASOLINE RETAIL SALES IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE MORAVE COUNTY GENERAL AREA, MORA YE COUNTY, ARIZONA. WHEREAS, the following described Findings of Fact are for the above captioned item: WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 6, 1995, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Star Auction, Appraisal & Country Store, Inc., being represented by Susan A, Pojmanski of Dolan Springs, Arizona, and WHEREAS, the site is located east of Highway 93 and south of Pierce Ferry Road in the Lake Mohave Commercial Center. The site is accessed from Highway 93 via northeast on Pierce Ferry Road to the site. The property is on the south side of Pierce Ferry Road. The property is relatively flat and has two structures on the property. The surrounding land uses consist of other small businesses and there are residences to the southeast. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant is proposing to sell retail gasoline at her business. The gasoline will be stored in aboveground tanks that are environmentally approved. The Mohave County General Plan designates this area as a Rural Development Area and is designated an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #04005S-ISOOC indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area, and a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. . -... . . RESOLUTION NO. 95-462 Page 2 PAGE 2 OF 2 BK 2645 PG 409 FEE~95058442 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 11, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. The applicant shall comply with all applicable state and fire marshal requirements and any required state permits. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained to include a right-of-way permit from the Mohave County Public Works Department if any work is done in the public right-of-way. MORA YE COUNTY BOARD OF SUPERVISORS 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 22,1995, and posted October 20,1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 6, 1995, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~r~J .c- Pat Holt, Chairman
