A RESOLUTION SETTING FORTH A REZONE OF LOT 20, SUNWARD HO! RANCHES,
NUMBER 2, TORO ACRES, IN SECTION 19, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM
A-R/I0A (AGRICUL TURAL-RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/
5A (AGRICULTURAL-RESIDENTIALIFIYE ACRE MINIMUM LOT SIZE) ZONE, IN THE
MORAVE COUNTY GENERAL AREA, MORA YE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
6, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by Scott Sayles of Kingman, Arizona, and
WHEREAS, this property is located north of Kingman, east of Stockton Hill Road on Calle
Caliente. The site is accessed from Stockton Hill Road, east on Calle Chavez, then south on A venida
Ramirez to Calle Caliente. The property is on the south side of Calle Caliente, approximately one-quarter
mile east of A venida Ramirez. The property is vacant. The terrain is gently rolling, sloping from the
southwest comer of the site and from the northern boundary towards a minor wash, running west to east,
which bisects the property. The surrounding land uses consist of undeveloped land and sparse home sites,
and
WHEREAS, the applicant proposes this zone change to allow for additional agricultural/residential
land development. The applicant proposes to divide the 16.54-acre (gross) property into three 5-plus-acre
lots. The Mohave County General Plan designates this area as a Suburban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2l55B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect on the property complies with the Mohave County
General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. A minor wash, running west to east, bisects the property.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 11, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
1. These parcels will be rezoned A-R/5A (Agricultural-ResidentiallFive Acre Minimum Lot
Size).
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The Board of Supervisors accepts the dedication of the 20- foot radius curve required at the
intersection of Calle Caliente, a dedicated roadway, and the 30-foot IngresslEgress (lIE)
easement granted in item number 4 below.
4. The Board of Supervisors accepts the granting of a 30-foot wide easement along the
property's western boundary extending some 880 feet to the rear parcel and beginning
immediately south of Calle Caliente as an IngresslEgress and Public Utilities Easement (lIE
and PUE).
5. The dedications and grantings required by the Rezone resolution shall be shown on the
Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8, The Parcel Plat shall show any surface drainage and FEMA flood zones.
9. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
10. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 1 I -829E.
1 I. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, October 22, 1995, and posted October 20, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting
on Monday, November 6, 1995, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
