RESOLUTION NO. 95-459 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 61, SPRING VALLEY RANCHES, UNIT 1, IN SECTION 35, TOWNSHIP 23 NORTH, RANGE 14 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/ 7A AND A-R/5A (AGRlCULTURAL-RESIDENTIAL/SEYEN ACRE A.~D FIVE ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 2, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by the owner, Eugene Brown, of Kingman, Arizona, and WHEREAS, this property is located east of Hackberry and south of Route 66. The site is accessed from Highway 66 via south on Hackberry Road, then west on Spring Valley Road, then south on Frerichs Rauch Road, then west on Tree Line Drive, then south on Pine Valley Drive to the site. The property is vacant. The terrain is sloping from Pine Valley Drive to the south and slopes to the north at the south property line, creating a swale across the property. The surrounding land is vacant. There are several washes that cross the property, and WHEREAS, the applicant requests this zone change to allow for land division of the property. The applicant proposes to divide the 38.21-acre property into two 7-plus-acre parcels and three 5-plus-acre parcels. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2225B indicates the parcel described to be in Zone D, an area of undetermined, but possible flood hazards. The Mohave County Flood Control District reviewed the site on November 7, 1995, and observed that a FEMA tributary flows from east to west, through the middle of Parcel 61, with braided flows throughout the lots, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended with proper engineering and development. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. Significant environmental features affecting the site are several washes crossing the property. . . RESOLUTION NO. 95-459 Page 2 PAGE 2 OF 3 BK 2670 PG 368 FEE~960059~ WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The southern two parcels will be rezoned A-R/7A (Agricultural-Residential/Seven Acre Minimum Lot Size) and the northern three parcels will be rezoned A-R/5A (Agricultural- ResidentiallFive Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3, I 6 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The applicant will grant adequate legal access to the southwest parcel of this property. 4. The grantings required by the Rezone resolution shall be shown on the Parcel Plat. 5. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 6. Each parcel shall have legal access. 7. The Parcel Plat shall show any surface drainage and FEMA flood zones. Size and direction of washes will be delineated on the Parcel Plat. 8. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 9. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. Ifat the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 17, 1995, and posted December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . . RESOLUTION NO. 95-459 Page 3 PAGE 3 OF 3 BK 2670 PG 369 FEE~9600594 NOW THEREFORE BE IT RESOLYED, that the Board of Supervisors, at their regular meeting on Tuesday, January 2, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
