MOHAVE COUNTY RECORDER 11/08/95 08:03A PAGE 1 OF 2 ['iOHAVE COUNTY BOARD OF SUPERVISORS RECmWING FEE 0.00 RESOLUTION NO. 95-458 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 64, SPRING VALLEY RANCHES, UNIT 1, IN SECTION 31, TOWNSHIP 23 NORTH, RANGE 13 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIALrrHIRTY_SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/ 15A (AGRICUL TURAL-RESIDENTIALIFIFTEEN ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 6, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by E.R. Bruce Realty of Kingman, Arizona, representing Edward A. Goede of San Bernardino, California, and WHEREAS, this property is located south of Hackberry and west of Hackberry RoadIMohave County Route 141. The site is accessed from Highway 66, south on Hackberry Road approximately one-half mile to Spring Valley Road, then west on Spring Valley Road to Frerichs Ranch Road. The property is on the east side of Frerichs Ranch Road, approximately one and one-half miles south of Spring Valley Road. The property is vacant. The rolling terrain slopes gently eastward. The surrounding land uses consist of undeveloped land and one homesite to the north. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant proposes this zone change to allow for two residential lots. The applicant proposes to divide the 38.65-acre (gross) property into two equally-sized 19-plus-acre parcels. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2200B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County Generat Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. - ~ ""'- . . RESOLUTION NO. 95-458 Page 2 PAGE 2 OF 2 WHEREAS, at the public hearing before the Mohave CounifPl~g~~on'iftg~~~ion on October I], 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. These parcels will be rezoned A-R/15A (Agricultural-Residential/Fifteen Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. PAGE 2 OF 2 BK /i,45 PG~D 1 FEE~95058439 3. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 4. The Parcel Plat shall show any surface drainage and FEMA flood zones. 5. Each parcel shall have legal access. 6. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS I 1-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant aD. extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 22, 1995, and posted October 20, ] 995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
