A RESOLUTION SETTING FORTH APPROVAL OF FULFILLMENT OF THE
REOUlREMENTS OF CONDITION 19 OF BOS RESOLUTION NO. 90-15 TO DEYELOP A
RECYCLING FACILITY WHICH APPROVED THE REZONING OF AN APPROXIMATELY 415-
ACRE PARCEL LOCATED IN SECTION 8 AND A PORTION OF SECTIONS 5 AND 17,
TOWNSHIP 16 NORTH, RANGE 19 WEST, FROM A-R/36 (AGRICULTURAL-RESIDENTIAL!
THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, TO M-X (HEAVY MANUFACTURING)
ZONE, IN THE MOHA YE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday,
November 6, 1995, a public hearing was conducted to determine whether approval should be granted which
will establish the zoning for the above described property as requested by Franconia Technologies, a.k.a.
Waste Management of Phoenix, Inc., Phoenix, Arizona, and
WHEREAS, the property is located north ofInterstate 40 and east of Highway 95 at the Franconia
Interchange, and
WHEREAS, the surrounding land uses consist of vacant land with a few single-family residences
to the north, and
WHEREAS, the original rezone request for this site was approved on January 8, 1990, per BOS
Resolution No. 90-15. On October I, 1990 conditions required by BOS Resolution No. 90-15 were
modified per BOS Resolution No. 90-289. The first extension was granted on January 21, 1991, per BOS
Resolution No. 91-30. On December 2, 1991, BOS Resolution No. 90- I 5 was amended per BOS Resolution
No. 91-315. The second extension was granted on February 3,1992, per BOS Resolution No. 92-35. The
third extension was granted on December 7, 1992, per BOS Resolution No. 92-398. The fourth extension
was granted on October 4, 1994, per BOS Resolution No, 94-310. The fifth extension was granted on July
5, 1995, per BOS Resolution No. 95-293, and
WHEREAS, a letter dated August 29, 1995 from Don Cassano, Project Manager, Waste
Management of Arizona, submitted to Pat Holt, Chairman, Mohave County Board of Supervisors, quotes
the following: "Last month, I sent you a request to have the Mohave County Board of Supervisors consider
an amendment to the agreement between the Board and Franconia Technologies entered into on October 5,
1992. Subsequently, I met with several Mohave County staff members to review the request. As a result
of that meeting and based on direction provided by staff, I am now revising our application and request that
the Board pass a resolution indicating that Franconia Technologies has satisfied the terms of Condition No.
19 ofMohave County Resolution No. 90-15 and that the zoning is now 'full vested'," and

WHEREAS, Condition No. 19 of BOS Resolution No, 90-15 required the following: "The
owner/developer/operator(s) must commence development of this property through the design of plans for
the elevated roadway and purchase of legal right-of-way, the submittal to the Arizona Department of
Environmental Quality for permitting approval for the purpose as outlined and conditioned herewith and be
able to show proof of same within one (I) year of the approval of this rezone. Extensions of time may be
granted for one (I) year increments by the Board of Supervisors upon request by the applicant or his assign.
Failure to do so will revert the zoning of this property back to its prior classification, namely, A-R/36A
(AgriculturaJ-Residential/Thirty-six Acre Minimum). Any request for an extension shall be granted if the
Board concludes that due diligence is being exercised to develop the property in accordance with the
conditions enumerated, and

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 11, 1995, the Commission recommended APPROVAL for fulfillment of the requirements of
Condition No. 19 of BOS Resolution No. 90-15 subject to the following:
I. That Franconia Technologies, a.k.a. Waste Management of Phoenix, Inc., Phoenix, Arizona,
has fulfilled the obligations of Condition No. 19 ofBOS Resolution No. 90-15, and that the
M-X (Heavy Manufacturing) zoning be established as a permanent zoning designation for
that property referenced above.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, October 22, 1995 and posted on October 20,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLYED, that the Board of Supervisors, at their regular meeting
on November 6, 1995, APPROVED this fulfillment of the requirements of Condition No. 19 of BOS
Resolution No. 90-15 as recommended by the Mohave County Planning and Zoning Commission and
outlined herein.
