INDEXED 9~5058437 BK 2645 PG 396 OFFICIAL RECORDS OF MDHAVE COUNTY, AZ JOAN HC CALL, MOHAVE COUNTY RECORDER ji/08/9~ DSI02A PAGE 1 OF 2 NOHAVE COIJNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 95-456 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. c.' -18 AND 91-19 WHICH APPROYED THE PRELIMINARY SUBDIVISION PLAN AND REZOIG FOR GOLDEN ACRES, TRACT 3028, BEING THE S\I, OF PARCEL 62 AND PARCELS t 67 AND 68, SECTION 18, TOWNSHIP 21 NORTH, RANGE 18 WEST, IN THE GOLDEN VALLEY AREA, MOHA YE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday, November 6, 1995, a public hearing was conducted to determine whether approval should be granted for a Rescission of a Resolution of a Preliminary Subdivision Plan and Rezone for the above described property, and WHEREAS, the resolution which approved this subdivision indicates the developer of this tract was Lee Roy and Dorothy Ollar, Golden Valley, Arizona. The engineer of record is noted as South Pointe Consultants, Bullhead City, Arizona, and WHEREAS, the subdivision is located south of Highway 68, west of Colorado Road and north of Redwall Drive, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on January 7, 1991, per BOS Resolution No. 91-18. The property was rezoned per BOS Resolution No. 90-19, and WHEREAS, the first Extension of Time was granted on March 8, 1993, per BOS Resolution No. 93-63. The second extension was required on January 7,1994, and the third extension on January 7, 1995, which would have brought the subdivision current. No additional Extensions of Time have been requested by the owner. Letters have been sent to the owner notifying them that approval of their subdivision expired, and an Extension of Time was required. There has been no response to the Planning and Zoning Department's inquiries, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action is in concurrence with the Mohave County Extension of Time Policy. ~. . . RESOLUTION NO. 95-456 PAGE 2 OF 2 BK 2645 PG 397 Page 2 FEE~95058437 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October II, 1995, the Commission recommended APPROVAL for a Rescission of a Resolution for a Preliminary Plan and a Rezone subject to the following: 1. That BOS Resolution Nos. 91-18 and 91-19 be rescinded. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 22, 1995 and posted on October 20, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ATTEST: MOHA VE COUNTY BOARD OF SUPERVISORS NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting on November 6, 1995, APPROVED this Rescission of a Resolution for a Preliminary Plan and a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ..f;! ~~) Pat Holt, Chairman
