A RESOLUTION SETTING FORTH A REZONE OF PARCEL 66, IN THE SEV. SWv. OF
SECTION 18, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-RJI0A (AGRICULTURAL-
RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE TO A-Rl6A AND A-R/2A
(AGRICULTURAL-RESIDENTIAL/SIX ACRE AND TWO ACRE MINIMUM LOT SIZE) ZONES,
IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
6, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by RW. Holmquist & Associates of Kingman, Arizona, representing
Gregory and Linda Livingston of Escondido, California, and
WHEREAS, this property is located south of Highway 68 on Redwall Drive between La Osa Road
and Ligurta Road. The site is accessed from Highway 68, south on Teddy Roosevelt Road, then east on
Redwall Drive approximately one-quarter mile to the site. The property is on the northeast comer of La Osa
Road and Redwall Drive. The property is vacant. The terrain is generally flat. The surrounding land uses
consist of undeveloped property and scant homesites. Two washes, running north to south, converge on
the property and flow across Redwall Drive near La Osa Road, and
WHEREAS, the applicant proposes this zone change to allow development of five "ranch" style lots
on the property. The applicant proposes to divide the 39.98-acre (gross) property into two 10-plus-acre lots,
two 7-acre lots and one 2-acre lot. The Mohave County General Plan designates this area as an Urban
Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect on the property complies with the Mohave County
General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.

f. There are two washes crossing 1he site which drain onto RedwaU Drive. The site is also in
the 100-year floodway which may require special septic systems.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission
on October II, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
1. These parcels wiU be rezoned A-R/IOA, A-R/7A and A-R/2A (Agricultural-Residential/Ten
Acre, Seven Acre and Two Acre Minimum Lot Size) as shown in Exhibit "A".

2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The Board of Supervisors accepts the dedication of the west 30 feet of this parcel known as
La Osa Road, the north 30 feet of this parcel known as Collins Drive, the east 35 feet of this
parcel known as Ligurta Road due to the half section alignment of this road, and the south
50 feet of this parcel known as Redwall Drive as road rights-of-way. In addition, 20-foot
radius curves are required at all dedicated roadway intersection points.
4. The Board of Supervisors accepts the granting of the eight feet adjacent to all roadways as
a Public Utility Easement (PUE).
5. The dedications and grantings required by the Rezone resolution shall be shown on the
Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The Parcel Plat shall show any surface drainage and FEMA flood zones.
9. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
10. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.
11. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title II, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, October 22,1995, and posted October 20, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 6, 1995, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
