NOHAVE COUNTY RECORDER li/08/9~ 08:00A PAGE 1 OF 3 f'iOHA\lC COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 95-451 A RESOLUTION SETTING FORTH A REZONE OF THE EASTERLY 707.25 FEET OF PARCEL 28, IN SECTION 7, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-RlI0A (AGRICULTURAL-RESIDENTIALITEN ACRE MINIMUM LOT SIZE) ZONE TO A-Rl5A (AGRICULTURAL-RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 6, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by R. W. Holmquist and Associates of Kingman, Arizona for the owner, John Dawson of Pine Valley, California, and WHEREAS, the property is located south of Highway 68 on Colorado Road. The site is accessed from Highway 68 via south on Colorado Road. The property is located approximately one-half mile south of Highway 68 on Colorado Road at the northwest comer of Shipp Drive and Colorado Road. The property is vacant. The terrain is sloping slightly to the southeast. The surrounding land is vacant with one residence to the southwest. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this zone change to allow lease, development and sale of property. The applicant proposes to divide the 36.96 acres into one parcel of 15.09 acres and four parcels' of 5 acres. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. 1- < . . RESOLUTION NO. 95-451 Page 2 PAGE 2 OF 3 BK ~6~5 PG 382 FEE~95058432 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 4, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The eastern four parcels will be rezoned A-R/5A (Agricultural-ResidentiallFive Acre Minimum Lot Size) and the western parcel will stay A-R/IOA (Agricultural-Residential/Ten Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The Board of Supervisors accepts the dedication of the 30 feet along the north boundary known as Brook Drive and the 30 feet along the west boundary known as Lochiel Road as road rights-of-way. In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. The Board of Supervisors accepts the granting of the eight feet adjacent to all roadways as a Public Utilities Easement (PUE). 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 11. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. 't . . RESOLUTION NO. 95-451 Page 3 PAGE 3 OF 3 BK 2645 PG 383 FEE~950S8432 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 22, 1995, and posted October 20, 1995 as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 6, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
