PAGE 1 OF 5 BOARD OF SUPERVISORS RECORDIHG FEE 0.00 HC 'M1CflOf'lLME,Q RESOLUTION NO. 90-225 A RESOLUTION SETTING FORTH APPROVAL OF A PRELIMINARY SUBDIVISION PLAN FOR DESERT LAKES IV, TRACT 4076-D, BEING A PORTION OF SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY, MORAVE COUNTY, ARIZONA WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on August 20, 1990, a public hearing was conducted to determine the approval of the preliminary subdivision plan and petition of exception for Desert Lakes IV, Tract 4076-D, being a new tract formed from a portion of Desert Lakes, Tract 4076-B. In order for this tract to be subdivided, it is necessary to abandon, vacate, or extinguish Lots 75-86, Block F, a cul-de-sac road, a portion of a golf course and drainage, public utility, ingress/egress easements, and vehicular non-access easements of the aforementioned Tract 4076-B, and WHEREAS, the owner/developer of this tract is Desert Lakes DevelopmenL, L.P., a Delaware Limited Partnership, and WHEREAS, the engineering firm responsible for the preparation of the design of this subdivision is Holland West of Denver, Colorado, with offices in Bullhead City, Arizona, and fM>' "}',,,..,l ~'J\~ ,;,;;~q f,~j'\l~., l{~":;~ itl:.\' '/"">'" PAGE 2 OF 5 BK 1779 PG 260 (FEEt90- 59798) Resolution No. 90-225 Page 2 WHEREAS, the ne., tract is within the existing recorded subdivision of Desert Lakes, Tracts 4076-B and 4076-C, and is of identical uses as these tracts. Access is by Lipan Boulevard and/or Mountain view Road via Desert Lakes Boulevard, and WHEREP~, reviews have been received from the Mohave County Health Department, Bermuda Water Company, Inc., the Fort Mojave Mesa Fire Department, Sorenson Utilities (sewage) and considered or incorporated in the' evaluation of this tract, and WHEREAS, the Conunission at their meeting on August 8, 1990 did recommend conditional approval of the preliminary subdivision plan for Tract 4076-0 with the following conditions noted: A. Desert Lakes, Tract 4076-0, a subdivision of 2.32 acres proposed to be divided into twelve (12) residential lots is already zoned as Special Development (SO) district. B. Petitions of exception were submitted for the following exceptions to the Mohave County Subdivision Regulations: 1. Eight (8') foot width front lot public Utility easements instead of sixteen (16') foot rear lot line easements. 2. Long blocks greater that 1320 feet in length w~en combined wi 1:h the blocks of adj oining tract. Resolution No. 90-225 2. The utilities prefer the eight ( 8') foot wide Public Utility Easements along the front lot line. The sixteen (16') foot wide Public Utility Easements at the rear lot line would serve no purpose. 3. Granting a Petition of Exception for thirty-two (32 ') foot right-of-way for this access road rather than forty (40') feet will not be detrimental to the public welfare or injurious to other adjacent properties because the needed travel lanes will be adequately contained within the proposed thirty-two (32') foot right-of-way and additionally, an eight (8') foot utility easement is provided in the front yards to contain public utilities so that they do not have to be constructed under the street pavement. C. The subdivision is designed for sewage disposal through a functioning sewage disposal plant which serves all of Desert Lakes lots. The facility is operated by Sorenson Utilities. D. The preliminary approval of this tract is based on the understanding of the Commission that the primary access to this subdivision is Lipan Boulevard and Mountain View Road. The direct access to the lots is from a frontage road separated from the section line arterials by a tinted patterned concrete median constructed by the developer. E. The approval of this subdivision is based on the understanding of the Mohave County Planning and Zoning Commission that all streets within the subdivision will be constructed and paved with asphaltic concrete and shall include curb and gutter, in accordance with Standard Specifications #171 and #101.10D of the County Engineering Road Standards or better. A water supply and distribution system including adequate pressure and volume for fire flows will be constructed to serve each lot. Grading and drainage related improvements will be made as recommended by the design engineer. Electric and telephone service shall be provided to each lot in accordance with Arizona Corporation Commission Regulations. All lots and street centerline monuments will be staked and monumented in accordance with Standard Specification No. 102 of the County Engineering Road Standards. Fire hydrants will be provided at locations prescribed by the Fort Mojave Mesa Fire Department. Street name and regulatory signs will be installed in accordance with the requirements of the Mohave County Subdivision Regulations and as approved by the Planning Commission staff; and, as a condition of approval, _'\..t , . ~SE 4 OF 5 BK 1779 PG 262 (FEEt90- 59798) Page 4 Resolution No. 90-225 the owner/subdivider is responsible for the completion of improvements and shall provide an assurance for all required subdivision improvements in accordance with Article V of the Mohave County Subdivision Regulations. F. This project is within the Mohave Valley Irrigation and Drainage District. G. The following standard conditions are noted that apply to all submittals at this stage: 1. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Commission as is required for approval of this tract by the Board of Supervisors. 2. Arizona Department of Water Resources determines that there is adequate water supply to serve this subdivision. 3. The water system will provide adequate flows for fire protection. The water supply system is in place, approved with the recording of Tract 4076-B. 5. Arizona Department of Environmental approves the sewage disposal system. Quality 6. The minimum lot size shall be 6,000 square feet in area. H. Further conditions for the approval of this tract are as follows: 1. Draft of the Covenants, Restrictions must be submitted. Conditions qnd 2.
