RESOLUTION NO. 95-203
RESOLUTION ORDERING THE FORMATION OF CHLORIDE DOMESTIC WATER
IMPROVEMENT DISTRICT OF MOHA VE COUNTY, ARIZONA.
WHEREAS, a petition was filed with the Clerk of the Board of Supervisors of Mohave
County, Arizona, on April 3, 1995, praying for the establishment of a domestic water improvement
district to be known as the Chloride Domestic Water Improvement District of Mohave County,
Arizona, under the provisions of Section 48-901 through 48-965, and 48-1011 through 48-1018, all
inclusive, Arizona Revised Statutes (the "County Improvement District Statutes") for the purpose
of acquiring an existing or constmction of a domestic water delivery system; and
WHEREAS, after proceedings to that end duly had and taken pursuant to Arizona Revised
Statute, Title 48, Chapter 6, Articles 1 and 4, this Board did, on this day, conduct a public hearing
on the formation of Chloride Domestic Water Improvement District of Mohave County, Arizona;
and
WHEREAS, notice of hearing has been given by publication, posting and mailing as
required by law; and
WHEREAS, ten (10) persons wishing to object to the establishment of the proposed district
have filed their written objections with the Clerk of this Board, and two (2) appeared at the hearing
and presented oral objections thereto; and petitions containing 105 signatures were presented to the
Board; and
WHEREAS, four (4) additional speakers were heard regarding same; and
WHEREAS, it was determined by the Board of Supervisors that it would be in the best
interest of the property owners that the Public Hearing be continued to the May 15, 1995, to allow
a meeting to be held in the area so that County Officials and others could present the facts and clarify
questions and concerns of the property owners; and
WHEREAS, no verbal or written objections to the establishment of the proposed district
were presented on this 15th day of May, 1995; and

. NOW, THEREFORE, IT IS FOUND, DETERMINED, ORDERED AND RECORDED
AS FOLLOWS:

1.
That the petition presented to this Board as a result of which it set this hearing, and
the amendment thereto, were each signed by the requisite number of owners of real
property within the proposed district, and are sufficient.
2.
That the public convenience, necessity and welfare will be promoted by the
establishment of the district.
3.
That all of the property within the proposed district will be benefitted by being
formed into such district and that said proposed district includes all of the property
that would be benefitted by being so formed.
4.
That the boundaries of said district are hereby established as those more particularly
set forth as:
A portion of Sections 3 and 4, T 23N, R l8W, G&SRM, Mohave County, Arizona,
more particularly described as follows; Govenunent Lots 2,3,4, and N Yz Gov't Lot
6, S Yz NW 1/4, NW 1/4, NW 1/4 SW 1/4, and that portion of Section 4, more
particularly described as follows: that portion of Gov't Lot 6 lying Easterly of the big
Boy Patented Mining Claim (MS3400) and the Valley View Patented Mining Claim
(MS l273A).
5.
That said territory is hereby declared formed into a county domestic water
improvement district under the corporate name of Chloride Domestic Water
Improvement District of Mohave COlmty, Arizona, by which name it shall be
known in all proceedings. Said district shall be authorized to make nay local
improvements and take all other actions and exercise all other powers of a county
domestic water improvement district as may now or hereafter be granted under law.
6.
The district shall be governed by an elected board of directors consisting of six (6)
members. The initial directors shall be as follows:
1) Hal Olson
2) Ray Nelson
3) Lea Collins
4) Helen Burns
5) Robert Warren
6) Danny Schull.
Subsequent directors shall be elected by the qualified electors of the district and will
serve for four year terms.

Elections for directors will be held at the regular county general election held
immediately prior to the expiration of a term.
7.
Said district shall hereafter be body corporate with the powers of a municipal
corporation for the purposes of carrying out the provisions of applicable law.
8.
The Clerk shall mai 1 a copy of this order to the Department of Revenue and to the
County Assessor of this County pursuant to Arizona Revised Statutes section 42-483
9.
A copy of this resolution will be recorded in the office of the Mohave County
Recorder.
