HomeMy WebLinkAbout1991-02 1,3 46/,) ORDINANCE NO. 91-2 WHEREAS, Mohave County Board of Supervisors is authorized pursuant to A.R.S. 11-251 (40) to enact an Ordinance under its policing authority prescribing reasonable curfew in unincorporated areas of the County for persons under the age of eighteen ( 18) , and WHEREAS, a petition has been filed by Rainbow Acres subdivision and Tierra Verde subdivision, representing a majority of the home owners in Rainbow Acres Subdivision and Tierra Verde Subdivision located in Mohave Valley, Arizona, requesting that a curfew be established for that area, and WHEREAS, the Mohave County Board of Supervisors has determined that the public' s health, safety, and welfare would be promoted by the enactment of a curfew in Rainbow Acres subdivision and Tierra Verde subdivision, and THEREFORE, the Mohave County Board of Supervisors hereby enacts the following Ordinance, A. It shall be unlawful for any person under the age of eighteen ( 18) year of age to remain in or upon any street, alley or public place within the boundaries of Rainbow Acres subdivision and Tierra Verde subdivision, Mohave Valley, Arizona, between the hours of 10:00 P.M. , and 5:00 A.M. , Sunday through Thursday, and 11:00 P.M. to 5:00 A.M. , Friday and Saturday unless such person is accompanied by a parent, guardian or person having legal custody of such minor. It is unlawful for any parent, guardian or other person having the legal care and custody of any person under the age of eighteen ( 18) years to allow, suffer or permit such child, to remain upon any of the streets, alleys or public places within the boundaries of Rainbow Acres subdivision and Tierra Verde subdivision, Mohave Valley, Arizona, between the hours of 10:00 P.M. and 5:00 A.M. , Sunday through Thursday, and 11 :00 P.M. to 5:00 A.M. , Friday and Saturday. C. A violation of the Ordinance shall be a petty offense and punishable by a fine not to exceed $300.00. D. In the event that a minor subject to this Ordinance is required for purposes of employment to be upon the streets, alleys or public ways during the curfew hours, he shall have in his possession proof of such employment and written permission from his parent, legal guardian or custodian.
