OFFICIAL RECORDS OF MOHAVE COUNTY, AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 09/11/95 03:45P PAGE 1 OF 2 ORDINANCE NO. 95-2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 An Ordinance of the County of Mohave adopting provisions of Bullhead City Ordinance 94-699, WHEREAS,the County of Mohave is required to subcontract with Bullhead City for delivery of Colorado River water to the Davis Camp area under Bullhead City's contract with the United States of America, and WHEREAS,under that Agreement the County of Mohave is required to report and manage the amount of water diverted for their use for ultimate reporting to the Bureau of Reclamation by Bullhead City, and WHEREAS,failure to report could constitute grounds for termination of the contact between Bullhead City and the United States of America and the subcontract involving Mohave County, THEREFORE, BE IT ORDAINED AS FOLLOWS: WHEREAS: Enacting the following provisions of Bullhead City Ordinance 94-699 as modified herein as and for Ordinances of Mohave County for the limited purpose of complying with the requirements of Contract No.2-07-30-W0027 between the City of Bullhead City and the United States of America under which Mohave County is a subcontractor. Water Allocations for certain Commercial and Industrial Uses. Section 1: No building permit shall be issued for construction of commercial and industrial uses on vacant parcels which are estimated by the Community Development Department of the City of Bullhead City to consume more than 0.3 acre feet per year of water for each parcel involved, whether such parcels result from lot splits or platted lots, that do not have a prior water allocation that is adequate to serve the intended use without first obtaining an adequate water allocation from the City Council of Bullhead City for the development. Allocations shall be based upon the principle of"first come first served". The new allocation applied for shall represent the difference between the original water allocation assigned to such parcel and the estimated demand for water usage resulting from the commercial or industrial development. Any requests for a new allocation shall be based on an engineer's estimate of water usage for the proposed project approved Y ' PAGE 2 OF 2 11K 2620 PG 302 FEE495047731 by the community Development Department of the City of Bullhead City. If approved by the City Council,such allocation will be granted at the time of issuance of the necessary construction permits. Section 2: No final approval, as defined in Article 3.14, Mohave County Subdivision Regulations, shall be granted by the Mohave County Board of Supervisors to record any final subdivision plat within the Contract Service area as depicted on Exhibit "A", until and unless the subdivider obtains a water allocation for the proposed development from the Bullhead City Council or their designee. The new allocation applied for shall represent the quantity of water necessary to serve the platted lots or parcels within the subdivision and shall be calculated using Arizona Department of Water Resources criteria as follows: A. Single Family Residential - 250 gallons per day B. Multiple Family Residential - 200 gallons per day C. Commercial and Industrial - 0.3 acre feet per year per parcel.
