HomeMy WebLinkAbout2000-02 PAGE 3 OF 7 Bk:. 3612 PG 28 F'EE11,2000059o1,2 7 MOHAVE COUNTY ORDINANCE NO. 2000-02 AN ORDINANCE AMENDING SECTION 9, DEFINITIONS, AND SECTIONS 13, 13.1, 15, 19, 20, 21, 21.1, 22, 22.1, 23, 24, AND 27.H OF THE MOHAVE COUNTY ZONING ORDINANCE FOR THE ADDITION OF FENCING AND BUFFERS IN COMMERCIAL AND INDUSTRIAL ZONES. Amend the Mohave County Zoning Ordinance as follows (added language is bolded; deleted language is struck): Section 9 DEFINITIONS - Add the following definitions: Between Automobile Wrecking and Boarding House: (ir•F Barrier: Anything that prevents passage or approach, an obstruction, as a fence, wall, etc. Between Barrier and Boundary, Zone: Berm: An earthen mound usually man made and in excess of two (2) feet in height used to shield or buffer properties from adjoining uses, noise or highway visibility. Between Boundary, Zone and Building: Buffer: A wall, fence, or barrier used to lessen the visual impact of stored materials or incompatible land uses. Between Commission and Contractor's Yard: Containment: Confining or being confined; limitation, restriction or restraint. Between Easement, Roadway and Exception: Enclosure: An enclosing or being enclosed; something that encloses, as a fence, wall, etc., something enclosed; an enclosed place or area. Between Feedlots and Final Plat: Fence: A sticture usuallybuilt-to rate two (2) parcels of laud or separate a parcel into different use P arms, MOHAVE COUNTY ORDINANCE NO. 2000-02 Page 2 Fence: A barrier, as a wooden fence or metal posts, rails, wire mesh, etc., used as a boundary or means of protection or confinement. Between Veterinary Clinic and Wall: View-Obscuring: Shall mean any structure or device forming a physical barrier which is so constructed that fifty percent (50%) or more of the vertical surface is closed and prevents the passage of light, air and vision through said surface. Between Wall and Warehousing: Wall: Shall mean any structure or device forming a physical barrier which is so constructed that fifty percent (50%) or more of the vertical surface is closed and prevents the passage of light, air and vision Wall: An upright structure of wood, stone, brick, frame stucco, serving to enclose, divide, support, protect or obscure the view; a continuous structure serving to enclose an area. A view-obscuring device, as per Section 27.H.4, will be placed on all property lines abutting against Agricultural, Residential properties or incompatible uses if the property is used for General Commercial uses. Section 20 REGULATIONS FOR NEIGHBORHOOD COMMERCIAL OR"C-1"ZONE A. Special Provisions. 5. A view-obscuring device, as per Section 27.11.4, will be placed on all property lines abutting against Agricultural, Residential properties or incompatible uses. Section 22 REGULATIONS FOR COMMERCIAL-MANFACTURING OR"C-M"ZONE A. Special Provisions. 1. All applicable provisions of Sections 25, 26, 27, and 31 shall apply to this zone. 2. A view-obscuring device, as per Section 27.11.4, will be placed on all property lines abutting against Agricultural, Residential properties or incompatible uses. Special Provisions. 1. All applicable provisions of Sections 25, 26, 27, and 31 shall apply to this zone. 2. A view-obscuring device, as per Section 27.H.4, will be placed on all property lines abutting against Agricultural, Residential properties or incompatible uses. Section 23 REGULATIONS FOR GENERAL MANUFACTURING OR"M"ZONE E. Development and Performance Standards. 5. A view-obscuring device, as per Section 27.11.4, will be placed on all property lines abutting against Agricultural, Residential properties or incompatible uses. Section 24 REGULATIONS FOR HEAVY MANUFACTURING OR"M-X"ZONE (kir F. Development and Performance Standards. 3. A view-obscuring device as per Section 27.H.4 will be placed on all property lines abutting against Agricultural,Residential properties or incompatible uses. Section 27. GENERAL PROVISIONS Section 27.H.4 Fences, Hedges, and Similar Structures. 4. ^,,y u e or open lot storage, including the storage of vehicles, equipment, materials, if and when any nonresidential use is installed or extended if not located within a completely enclosed building shall be completely enclosed by a view obscuring fence which extends two (2) feet above the highest item to be stored, with a minimum of six (6) feet and a maximum of eight (8) feet in height. Such a fence shall display no advertising except for a permitted sign. 4. Standard for Commercial and Industrial Districts and Uses: a. General provisions: 1) All Commercial or Industrial Zones and uses will comply with "view- obscuring" as defined in the following performance standards. 2) The height of the view-obscuring device shall be measured from the highest finished adjacent grade of the element to be obscured. MOHAVE COUNTY ORDINANCE NO. 2000-02 Page 5 3) All lots/parcels shall comply with this section in fencing, enclosure, enclosing, or containing of materials stored outside of any structure and for any work conducted outside of a building. 4) When adjacent to residential uses, the entire perimeter view- obscuring device along interior property lines shall be installed in the first phase of development or construction. 5) View-obscuring structures will be required where any incompatible uses are abutting or adjacent to each other. 6) The view-obscuring devices shall be of masonry construction, wood, stone,brick, frame stucco, chain link, earthen berms or live vegetation materials equivalent in effect to that required in the definitions of view-obscuring and shall not be reflective. 7) All lots/parcels shall view-obscure from public rights-of-way, ingress and egress easements, or public access. 8) Enclosure/containment fencing may be used to separate and view- obscure materials storage areas outside of buildings so fencing the perimeter would not be required. 9) Manmade earthen berms will only be allowed on lots or parcels greater than two and one-half(2%) net acres and a minimum setback of five (5) feet. Natural-occurring berms can be used on lessor acreage. b. Performance standards: 1) All view-screening will be constructed of materials normally defined as fencing materials. View-screening materials shall be slating or other material normally considered for fencing not to include plastic sheeting. 2) All view-screening will be a minimum of six (6) feet, unless otherwise required by the Board of Supervisors. 3) View-obscuring devices shall be installed and maintained for the duration of the uses requiring the screening to be in place. 4) No advertising will be allowed on any of the screening devices. 5) All earthen berms will require grading permits. 6) All berms require a five (5) foot setback to the toe of the slope and maximum design slope is 1% to 1. The above enclosure requirement shall not apply to plant nurseries, or to the display for sale of new and used cars, trucks, trailers, mobile homes, or the use and sale of farm and construction equipment in operational condition. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, October 16, 2000, APPROVED the attached Mohave County Ordinance No. 2000- 02, an amendment to Section 9, Definitions, and Sections 13, 13.1, 15, 19, 20, 21, 21.1, 22, 22.1, 23, 24, and 27.H of the Mohave County Zoning Ordinance for the addition of fencing and buffers in commercial and industrial zones, as recommended by the Mohave County Planning and Zoning Commission and outlined herein. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on October 16, 2000, a public hearing was conducted to determine whether an Amendment to Section 9, Definitions, and Sections 13, 13.1, 15, 19, 20, 21, 21.1, 22, 22.1, 23, 24, and 27.H of the Mohave County Zoning Ordinance for the addition of fencing and buffers in commercial and industrial zones should be approved, and WHEREAS, fencing and buffers and standards for commercial and industrial zones have not been reviewed for several years, and WHEREAS, fencing and buffers in the unincorporated areas of Mohave County requires regulations in order to protect and preserve property values and means that would protect the integrity of residential neighborhoods, and WHEREAS, the requirements for establishment of guidelines for the layout and construction of fences and buffers has evolved since Section 27 was adopted, and Mohave County needs to be sensitive to these changes, and WHEREAS, this amendment will clearly set the guidelines for the layout and construction of fences and buffers, the type of permitting required, the zones it will be allowed in, and the conditions to be met, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 13, 2000, the Commission recommended APPROVAL of the attached Mohave County Ordinance No. 2000-02, an Amendment to Section 9, Definitions, and Sections 13, 13.1, 15, 19, 20, 21, 21.1, 22, 22.1, 23, 24, and 27.H of the Mohave County Zoning Ordinance for the addition of fencing and buffers in commercial and industrial zones, and
