HomeMy WebLinkAbout2001-03 PAGE 2 OF 3 • BK 3762 PG 592 FEET20o11 i317i i5 MOHAVE COUNTY ORDINANCE NO. 2001-03 AN ORDINANCE AMENDING SECTION 25, SETBACKS AND AREA REQUIREMENTS, AND SECTION 27.F GENERAL PROVISIONS, YARD PROJECTIONS OF THE MOHAVE COUNTY ZONING ORDINANCE REGARDING RESIDENITAL SETBACKS AND YARD PROJECTIONS. The Mohave County Zoning Ordinance is amended as follows (added language is bolded; deleted language is strums): Section 25 SETBACKS AND AREA REQUIREMENTS Under Section 25.A. General Requirements, delete Section 25.A.5: A. General Requirements 5. Optional Mobile Home Setbacks on Lots: In all zones, except R MH Zone, wherein zoning action, mobile home may observe a ten (10) foot rear yard setback for the unit. If shall be observed: a. That portion of the mobile home and any attachments occupying the rear yard area shall count as part of the permitted fifty (50) percent, rear yard occupancy more than the permitted fifty(50)percent. B. Specific Requirements Under Section 25.B, Specific Requirements, correct footnote * as follows: * ----A 10-foot rear yard setback is allowed in conjunction with a mobile home. See also Sections 25.A.5, 27.F.6, 27.F.S7 and 27.G. Section 27 GENERAL PROVISIONS Amend Sections 27.F.6 and 27.F.7, Projections into Yards, as follows: F. Projections into Yards 6. For lots 7000 sq. ft. or less, &roofed, open-sided patios: roofed but otherwise unenclosed patios which are attached to and are a part of the main building, may extend or project into the required rear yard provided that such patio, together with all detached accessory buildings, shall not exceed fifty percent (50%) of the area required rear yard. At least ten (10) feet must be maintained between the rear property line and any main building, structural bearing wall or overhang. For residential lots greater than 7000 sq. ft., Tthe main building and/or structures which are attached to a part of the main building may extend or project into the required rear yard provided that such structures, together with all detached accessory buildings, shall not occupy more than fifty percent (50%) of the area of the required rear yard. At least ten (10) feet must be maintained between the rear property line and any main building, structural bearing wall or overhang. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on May 21, 2001, a public hearing was conducted to consider whether an Amendment to Section 25 and Section 27.F of the Mohave County Zoning Ordinance regarding residential setbacks should be approved, and WHEREAS, Section 25, SETBACKS AND AREA REAQUIREMENTS and Section 27.F, GENERAL PROVISIONS, Projections into Yards, have been amended several times since the original adoption of zoning ordinance, and WHEREAS, some of the amendments conflict with each other or are duplicative in nature, contributing to inconsistent interpretations over time, and create uncertainty for developers and the general public, and WHEREAS, it is the desire of the Planning and Zoning Commission to reduce uncertainty in the zoning ordinance, and WHEREAS, this amendment will clarify the relationship between setbacks and yard projections, and WHEREAS, at their meeting on April 11, 2001, the Planning and Zoning Commission APPROVED an Amendment to Section 25 and Section 27.F of the Mohave County Zoning Ordinance regarding residential setbacks should be approved, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 2, 2001, and posted on May 4, 2001, as required by Arizona Revised Statutes and the Mohave County Zoning Ordinance.
