ORDINANCE NO. 2005-06
AN ORDINANCE REQUIRING TRASH RECEPTACLES AT CONSTRUCTION SITES
WITHIN THE UNINCORPORATED AREA OF MOHAVE COUNTY
Section 1: For the purposes of this ordinance, the following terms shall have the accompanying
meanings:
a. Permittee shall mean the person or persons who have obtained a permit for construction
under Mohave County Ordinance 98-05 or the Mohave County Zoning Ordinance.
b. Trash receptacles shall mean trash bins, barrels, or other receptacles sufficient in number
and size, and constructed to prevent litter at the job site.
c. Job site shall mean premises where construction is permitted under this chapter.
Section 2: It shall be unlawful for any permittee to engage in construction in violation of this section.
Section 3: Permittees shall provide trash receptacles at the job site, and the receptacles shall be designed
as such to keep trash in during high wind periods.
Section 4: Trash receptacles shall be maintained in a clean, sanitary and neat condition.
Section 5: Trash receptacles must be removed from the construction site prior to final inspection.
Section 6: In addition to all other penalties provided by law, a building permit issued according the
adopted building code or the zoning ordinance may be revoked or suspended for failure to comply with
this ordinance.

A RESOLUTION SETTING FORTH THE ADOPTION OF ORDINANCE 2005-06, AN
ORDINANCE REQUIRING TRASH RECEPTACLES AT CONSTRUCTION SITES LOCATED
WITHIN THE UNINCORPORATED AREA OF MOHAVE COUNTY
WHEREAS, at their meeting on May 16, 2005, the Mohave County Board of Supervisors heard
a proposal for requiring trash receptacles at construction sites in the unincorporated area of Mohave
County; and
WHEREAS, residential and commercial construction has increased substantially in Mohave
County since 2000, and
WHEREAS, refuse and trash from construction sites is littering neighborhoods and public ways
creating a nuisance and detracting from established residences, and
WHEREAS, R.18.13-307 of the Arizona Administrative Code requires that trash and refuse be
stored according to that section, and
WHEREAS, this ordinance was noticed in the Kingman Daily Miner, a paper of general
circulation in Mohave County on May 1, 2005, as required by state law.
NOW THEREFORE BE IT RESOLVED, by the Mohave County Board of Supervisors that
Mohave County Ordinance 2005-06, requiring trash receptacles at construction sites, is adopted.
