ORDINANCE 2006-01
AN ORDINANCE TO PROHIBIT UNREASONABLE NOISE
IN A RESIDENTIAL AREA
A. It is unlawful for any person to knowingly make unreasonable noise which disturbs or
tends to disturb the peace or quiet of a residential area while carrying on a business, trade
or profession.
B. In a prosecution for a violation of this section, it shall be presumed that the noise made
was unreasonable if the noise was made after the hours of ten p.m. (10:00 p.m.) and
before five a.m. (5:00 a.m.) from May 1st to October 1st and before six a.m. (6:00 a.m.)
from October 1st to May 1St
C. Residential area is defined as an area zoned and used primarily for housing persons or
families.
D. A violation of this section shall be a Class 2 misdemeanor.
E. It is a defense to an alleged violation if the noise was the result of a bona fide emergency
occurring after the hours of ten p.m. (10:00 p.m.) and before five a.m. (5:00 a.m.) from
May 1St to October 1st and before six a.m. (6:00 a.m.) from October 1st to May 1st
