MOHAVE COUNTY RECOROEf 06/05/96 08:22A PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-176 A RESOLUTION SETTING FORTH APPROVAL OF A PETITION OF EXCEPTION FOR FOUNTAIN HILLS ESTATES, TRACT 3050, BEING A SUBDIVISION OF A PORTION OF THE SY1 OF SECTION 13, TOWNSHIP 22 NORTH, RANGE 17 WEST, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1996, a public hearing was conducted to determine whether approval should be granted for a Petition of Exception for Fountain Hills Estates, Tract 3050, and WHEREAS, the owner/developer of this subdivision is Renzi and Campbell Development, Inc., Flagstaff, Arizona. The engineers of record for the project are: David M. Monihan, P .E., RL.S., of WFM Engineers and Surveyors; Ted A. Luther, P.E., of Redstar Engineering; and Paul D. Trotta, PhD, P.E., all of Flagstaff, Arizona, and WHEREAS, the Preliminary Plan for this subdivision was conditionally approved by the Board of Supervisors on January 2, 1996, per BOS Resolution No. 96-21. The Preliminary Plan depicts 43 acres subdivided into 66 single-family residential lots, ranging in size from 20,002 to 37,162 square feet, and WHEREAS, a Petition of Exception was submitted by the developer during the review of the Final Plat of the above subdivision for the following: 1. Access roadway improvement standard less than the improvements for interior roads - This request is for a "rural roadway section" for the portion of Fountain Hills Road, from Stockton Hill Road to the boundary of the subdivision. Article 4.3-8 of the Mohave County Subdivision Regulations requires that access roads constructed to serve the subdivision shall be improved to the same standards required for the roads in the subdivision. WHEREAS, this Petition of Exception is submitted as a request that the Board of Supervisors grant the above exception from the Subdivision Regulations as outlined in Article 1.13 for the following reasons: A. The granting of this petition will not be detrimental to the public welfare or injurious to other adjacent properti es because: 1. Adequate access is provided by the proposed lesser standard of improvement. . . PAGE 2 OF 3 BK 27~2 PG 1~9 FEE~9630612 RESOLUTION NO. 96-176 Page 2 B. The request will not nullify the intent of the Master Plan of the County or other regulations because: I. Adequate access is provided by the proposed lesser standard of improvement. C. The special circumstances or conditions affecting said property are as follows: I. The additional width and improvements are not needed. 2. The additional width and improvements represent a maintenance expense and responsibility to Mohave County. 3. The proposed access road meets the Mohave County minimum roadway standards. 4. The proposed access road is comparable to existing County roads. WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan. c. The Mohave County Public Works Department has no objection to this Petition of Exception request for the use of a rural roadway section on Fountain Hills Road from Stockton Hill Road to the boundary of the development. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 8, 1996, the Commission recommended APPROVAL of the Petition of Exception for the above subdivision, subject to the following condition: I. The portion of Fountain Hills Road from Stockton Hill Road to the western boundary of Fountain Hills Estates, Tract 3050 shall be constructed to a rural roadway section. The remaining portion of Fountain Hills Road fronting the above development shall be constructed to the standard required as per BOS Resolution No. 96-21. As-Built Improvement Plans shall be submitted for review. WHEREAS, the advertising requirements have been met throughout this subdivision process as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . . PAGE 3 OF 3 BK 27~2 PG 150 FEE~9630612 RESOLUTION NO. 96-176 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1996, APPROVED the above Petition of Exception for Fountain Hills Estates, Tract 3050, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
