RESOLUTION NO. 96-29 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF WALNUT CREEK COMMERCIAL, TRACT 3022, BEING A RESUBDlVISION OF LOTS I AND 2, BLOCK 2, WALNUT CREEK ESTATES, UNIT 1, TRACT 3007 IN SECTION 7, TOWNSHIP 20 NORTH, RANGE 17 WEST, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Tuesday, January 2, 1996, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the above described property to representative G. Kelly Grier with Stovall Engineers, Inc., of Bullhead City, Arizona for the owner Walnut Creek Development Company, and WHEREAS, the commercial subdivision is located south of Kingman and west ofMcConnico. The site is accessed via south on Interstate 40 to the Oatman Road (Old Hwy 66) off-ramp, and WHEREAS, the surrounding land uses consist of single-family residential subdivisions, vacant land, and various commercial and industrial uses most notably those ancillary to North Star Steel's operation, and WHEREAS, the Preliminary Plan depicts 6.59 acres subdivided into six commercial lots of approximately equal size. The engineer of record for the subdivision is Stovall Engineers, Inc. of Bullhead City, Arizona, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on August 9, 1989 per P&ZC Resolution No. 89-179. The first Extension of Time was granted on October 5, 1992 per BOS Resolution No. 92-324. The second Extension of Time was granted on February 1, 1993 per BOS Resolution No. 93-048. The third Extension of Time was granted on January 3,1994 per BOS Resolution No. 94-022. The fourth Extension of Time was granted on February 6, 1995 per BOS Resolution No. 95-050, Article 3.10-1 states, "Upon application to the commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and WHEREAS, a letter dated October 30, 1995, from Stovall Engineers quotes the following: "Delays in development have been caused by shifting development priorities for Walnut Creek Estates Unit 3 (no Tract # given) and the Walnut Creek Water Company line extension. It is essential to our client's long range plans for his project, and his adjacent subdivision (Walnut Creek Estates Unit 3), that the approval for this project be kept alive." The planning staff has also contacted Jim Devlin, P.E. of Kingman who has just , . t RESOLUTION NO. 96-29 Page 2 PAGf 2 OF 2 BK 2670 PG 427 FEE~9600613 completed the design of the Walnut Creek Water line extension which will provide water to the site. According to Mr. Devlin, the application for permits required by the state to construct the water line will put ground breaking off for at least one year," and WHEREAS, this will be the fifth Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses. d. This request for an extension complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1. Compliance with all conditions ofP&ZC Resolution No. 89-179 and BOS Resolution Nos. 92-324,93-048,94-022 and 95-050. 2. This Extension of Time will be in effect until January 3,1997. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 17, 1995 and posted on December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on January 2,1996, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
