SEV. SEV. OF SECTION 23, TOWNSHIP 27 NORTH, RANGE 18 WEST, L YING NORTHERLY OF PIERCE FERRY ROAD, FROM A-R/36A (AGRICULTURAL-RESIDENTIALrrHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on January 16, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Citizens Utilities Company, being represented by Bruce A. Mitchell, P.E., Right-of-Way Supervisor, of Kingman, Arizona, and WHEREAS, this property is located approximately 16 miles north of the Pierce Ferry Road and U.S. Highway 93 intersection on the north side of Pierce Ferry Road between Dolan Springs and Stockton Hill Road. The site is accessed from Pierce Ferry Road. The property is vacant. The terrain is sloping slightly to the southeast. The surrounding land is vacant rangeland. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this zone change to establish an electrical substation on a 1.13- acre portion of Section 23. The Mohave County General Plan designates this area as a Rural Development Area. This is allowed under Section VII, Public Infrastructure Element of the Mohave County General Plan, and WHEREAS, a review of FEMA FIRM Panel #040058-1 625C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 96-26 Page 2 . . . PAGE 2 OF :r BK 2684 PG 547 - FEE~9606827 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This 1.13-acre parcel will be rezoned A-R (Agricultural-Residential/One Acre Minimum Lot Size), as shown on the attached "Exhibit A". 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. This will include a limited drainage report to mitigate any additional flows created by this development. 3. The submittal and recordation of a Record of Survey is required to show the location of this property. 4. The property shall have legal access. 5. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. 6. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 17, 1995, and posted December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
