INDEXED MICROFILMED BK 2670 PG 419 AZ RESOLUTION NO, 96-23 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 14, SPRING VALLEY RANCHES, UNIT ONE, IN SECTIONS 23 AND 26, TOWNSHIP 23 NORTH, RANGE 14 WEST, FROM A-R/ 36A (AGRICULTURAL-RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICUL TURAL-RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 2, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by E. R. Bruce, representing David A. Heytman, the owner, of Kingman, Arizona, and WHEREAS, this property is located south of Hackberry and west of Hackberry Road/Mohave County Route 141. The site is accessed from Highway 66, south on Hackberry Road about one-half mile to Spring Valley Road to the property at the corner of Spring Valley Road and Canyon View Lane. The property is vacant. The terrain is mountainous and sloping. The surrounding land use is vacant. There are significant drainage patterns that cross the property, and WHEREAS, the applicant proposes to divide the 36.26 acres into five parcels to allow sale of the property. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2200B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. A comment was made by the Mohave County Flood Control District that washes are not to be obstructed, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended with proper engineering and development. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f, There are significant environmental features affecting the site. RESOLUTION NO. 96-23 Page 2 ~ . . . PAGE 2 OF 3 BK 2670 PG ~20 FEEt9600615 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-Rl5A (Agricultural-Residential/Five Acre Minimum Lot Size) and each parcel will not exceed 10 acres. 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. Adequate legal Public Utility Easement (PUE) and Ingress and Egress (I&E) will need to be provided to each parcel. A 45-foot radius cul-de-sac will be granted to any dead end access roads or easements. 4. Twenty-foot radius curves should be granted at all roadway intersections. Roadways will be made to intersect at as near a 90 degree angle as possible with consideration for geometric design and sight distance. 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and will be accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. Size and direction of washes will be correctly delineated on the Parcel Plat. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after [mal Board of Supervisors approval for the change in classification, as per ARS 11-829E, II. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832, , . . .t RESOLUTION NO. 96-23 PAGE:3 OF 3 BK 26;0 PG ~21 FEE~9600615 Page 3 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 17, 1995, and posted December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 2, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein, MOHA VE COUNTY BOARD OF SUPERVISORS ATTEST: ~~kv "4 Pat Holt, C aIrman .....---~
