WHEREAS, at the regular meeting ofthe Mohave County Board of Supervisors held on January 2,1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Sherri D. Schultz of Golden Valley, Arizona, and WHEREAS, this property is located north of Highway 68, west of Highway 93 between Tooman Road and Bacobi Road. The site is accessed from Highway 93 via west on Agua Fria Drive to Bowie Road, then south on Bowie Road to the site. The site is located on the west side of Bowie Road approximately 450 feet south of Agua Fria Drive. The property has a double-wide mobile home on it. The surrounding land uses consist of residences and vacant property. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence man A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as a Suburban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2150B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: . . RESOLUTION NO. 96-16 Page 2 PAGE 2 OF 2 BK 2670 PG +02 FEE~9600608 I. This Zoning Use Permit is for a mobile home as a secondary residence on this property and the activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements), and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits, 3. A primary residence and a secondary residence is permitted. The secondary home may be occupied by a non-paying relative or guest ONL Y; none of the adult home care recipients may reside in the secondary home. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 17, 1995, and posted December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 2, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
