RESOLUTION NO. 96-14 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 16, GOLDROAD STATION, UNIT 8, IN SECTION 30, TOWNSHIP 20 NORTH, RANGE 18 WEST, FROM A-R136A (AGRICULTURAL-RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A- R/5A (AGRICULTURAL-RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 2, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by the owners, Ronald M. Combs and Rebecca Morgan, of Golden Valley, Arizona, and WHEREAS, this property is located via Oatman Road, west on Aquarius Road and south on Tombstone Trail to the property located at the corner of Quartzite Drive and Tombstone Trail. The property has one residence with two accessory buildings located on it. The terrain is flat, and the surrounding land is vacant. There is a significant drainage pattern that crosses the property, and WHEREAS, the applicant proposes to divide the 36.84 acres into five parcels for the purpose of resale. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2500B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area. Zone A is an area of the 100-year flood. The base flood elevation and flood hazard factors are not determined, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended, d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access, f. Secret Pass Wash affects the property significantly. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: RESOLUTION NO, 96-14 Page 2 . . The property will be rezoned A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) on the west half of the property, The east half will be rezoned A-Rl8A (Agricultural- Residential/Eight Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The 20-foot radius curve at the intersection of Tombstone Trail and Quartzite Drive will be dedicated as road right-of-way and accepted by the Board of Supervisors. 4. An eight foot public utility easement along the southern boundary adjacent to the dedicated right-of-way at Tombstone Trail and Quartzite Drive will be granted by the owners to the public. 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and the dedications will be accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. Flood zones will be delineated on the Parcel Plat. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. II. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 17, 1995, and posted December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. PAGE 3 OF 3 BK 2670 PG 398 FEEt9600606 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 2, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
