INDEXED 9b00605 8;', 2670 PG 394 OFFICIAL RECORDS OF tlOHAVE COUHTY, AZ ,lOAN Me CALL, MOHAVE COUNTY RECORDER 01/0~';96 01:24P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDIHG FEE 0.00 RESOLUTION NO. 96-13 A RESOLUTION SETTING FORTH AN ABANDONMENT AND REVERSION TO ACREAGE OF LOTS 4, 5, AND 6, BLOCK A, FAIRWAY ESTATES, PHASE 1, AMENDED, TRACT 4097-A, IN SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Tuesday, January 2, 1996, a public hearing was conducted to determine whether approval should be granted for an Abandonment and Reversion to Acreage for the above described property as requested by Richard Rieker, Ludwig Engineering, San Bernardino, California, agent for owner Glen and Pearle Ludwig of San Bernardino, California, and 'VHEREAS, this property is located in the Fort Mohave area approximately one-half mile east of Highway 95 on Joy Lane, then south on Clubhouse Drive to the site. The site is bounded by Clubhouse Drive on the west, Shasta Lake Drive on the south, and Fairway Estates, Tract 4097-A, on the east and north, and WHEREAS, the surrounding land uses consist of the subdivision Fairway Estates, Tract 4097-A. The lot lines of Lots 4,5, and 6 of Block A are proposed to be abandoned and reverted to acreage to create a new four-lot subdivision from the three original lots, requiring abandonment of the original lot lines and reversion to acreage, and then establishment of new lot lines with the approval of the new subdivision for which the preliminary plat was approved per BOS Resolution No. 95-449 dated November 6, 1995, and WHEREAS, the owner is proposing to build model homes on the lots stated above once final plat approval and new lot lines have been established. There are no streets or easements to be abandoned, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. The abandonment and reversion to acreage provides for recordation of Fairway Estates II, Tract 4157. b. Board of Supervisors Resolution No. 90-301, dated October 22,1990, approved the final plan for Fairway Estates, Tract 4097-A. c. All notices have been advertised and posted according to regulations. d. The proposed action and effect on the property complies with the Mohave County General Plan. e. The site is adequate for the action intended, and the use is consistent with the surrounding land uses and terrain. f. The surrounding area contains similar land uses to the above proposed action. . . RESOLUTION NO. 96-13 Page 2 PAGE 2 OF 2 BK 2670 PG 395 FEE~9600605 g. The site has legal access. h. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for an Abandonment and Reversion to Acreage subject to the following: I. The lot lines for Lots 4,5, and 6 of Fairway Estates, Tract 4097-A, as previously approved by BOS Resolution No. 90-301, dated October 22, 1990, shall be abandoned and reverted to acreage, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 17 and December 24, 1995 and posted on December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on January 2, 1996, APPROVED this Abandonment and Reversion to Acreage as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
