SWY.. OF SECTION 25, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Tuesday, January 2, 1996, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the above described property to Delmar L. Tilton, representing Sun Ventures of Port Orchard, Washington, and WHEREAS, the subdivision is located two and one-half miles south of Bullhead City's southerly border and one and one-quarter miles east of Highway 91. The site is accessed via south on Hwy. 95 to Joy Lane, then east on Joy Lane to the intersection of Mountain View Road, then north on Mountain View Road to Hammer Lane, then east on Hammer Lane to Van Mouwerick Drive, then south on Van Mouwerick Drive approximately one-quarter mile to the site, and WHEREAS, the property is bordered on the north by Sun Desert, Tract 4121, on the south by the Pine River Estates, Tract 4128, on the west by Tierra Del Rio, Tract 4048-D, and on the cast by unsubdivided properties. The subdivision is located within the Mohave Valley Irrigation and Drainage District. These projects lie on the western alluvial slope of the Black Mountains and are subject to flash flooding and sheet flow run-off. Given these factors, Pine River Estates, Sun Desert Estates and Moon Valley have been consolidated into one comprehensive drainage study, and WHEREAS, the Preliminary Plan depicts 5 acres subdivided into 16 single-family residential lots. The lots range in size from 9,800 square feet to 12,375 square feet yielding a density of3.2 units per acre. According to the developer, water service will be provided by the Bermuda Water Company, Inc. Sewage disposal is proposed to be by private, individual disposal systems, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on March 4, 1991 per BOS Resolution No. 91-063. The Final Plan for this tract was approved by the Mohave County Board of Supervisors on December 16,1991 per BOS Resolution No. 91-337. The first Extension of Time was granted on January 3,1995, per BOS Resolution No. 95-002. Article 3.10-1 states, "Upon application to the commission and prior to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and . . . , RESOLUTION NO. 96-10 Page 2 PAGE 2 OF 2 BK 2670 PG 385 FEE~9600602 WHEREAS, a letter dated October 30, 1995, from D.L. Tilton, states, "The reason that we are requesting tllis extension is that Moon Valley (Tract 4120) was submitted in conjunction with two other subdivisions, Moon Ridge, Tracts 4119 & 4119A and Sun Desert Estates (Tract 4121). Since Moon Valley is south of Moon Ridge and Sun Desert Estates, we have to wait for the development of Sun D~sert Estates in order to obtain access by paved roads, and also utilities for Moon Valley must come through Sun Desert Estates. It is our intention to develop Moon Valley as soon as we can obtain roads and utilities access to our north( ern) property line," and WHEREAS, this will be the second Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. This request for an extension complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the following: I. Compliance with all conditions ofBOS Resolution Nos. 91-063, 91-337 and 95-002. MOHA VE COUNTY BOARD OF SUPERVISORS 2. This Extension of Time will be in effect until December 16, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Ariwna, December 17, 1995 and posted on December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on January 2, 1996, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~&r~Y--> Pat Holt, Chairman ",
