SW'I. OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-l/2A (NEIGHBORHOOD COMMERCIALffWO ACRE MINIMUM LOT SIZE) ZONE IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 2, 1996, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above described property as requested by G. Kelly Grier of Stovall Engineers, Inc., of Bullhead City, Arizona, representing the owner/developer Dennis Gootrad of Westlake Village, California, and WHEREAS, the property is located two miles south of Bullhead City, east of Highway 95 and north of El Rodeo Road. The site is accessed from Highway 95 via east on El Rodeo Road to the site and is located on the northwest corner of El Rodeo Road and Calle del Media. The property is vacant and no improvements have been made in connection to the proposed commercial site. The Mohave County General Plan designates this area as an Urban Development Area. There are no significant dIainage pattenn on the property, and WHEREAS, this zone change was conditionally approved by the Mohave County Board of Supervisors on January 6, 1992, per BOS Resolution No. 92-5. An Extension of Time was granted on February I, 1993, per BOS Resolution No. 93-29; a second Extension of Time was granted per BOS Resolution No. 94-40 on February I, 1994; and a third Extension of Time was granted on February 6,1995 per BOS Resolution No. 95-35, and WHEREAS, the applicant is requesting an Extension of Time to complete this project. Stovall Engineers, Inc., stated in their letter dated October 20, 1995 "...the residential subdivision, Rodeo Park, Tract 4145 (preliminary Plan approved) and Rodeo Plaza, are under the same ownership, and are closely related. Sewer extensions in this area are not yet completed at this time: however, besides FMTUA, there is another sewage treatment system being negotiated and may be available in the near future. Mr. Gootrad has been in negotiation on both systems, and plans to develop these two projects as one of the sewer systems becomes available," and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and . . The approved Extension of Time Policy allows only two extensions of time when a developer is actively pursuing a schedule of completion, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. g. This request does not conform to the Mohave County Extension of Time Policy, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 13, 1995, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Continued compliance with the conditions ofBOS Resolution Nos. 92-5,93-29,94-40 and 95-35. 2. This Extension of Time will be in effect until January 6, 1997. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 17, 1995, and posted December 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, January 2,1996, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
