RESOLUTION NO. 96-8
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE SEY-
NEY- OF SECTION 18, TOWNSHIP 15 NORTH, RANGE 19 WEST, FOR A WATER STORAGE
TANK IN AN A-R/36A (AGRICUL TURAL-RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT
SIZE) ZONE, IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
2, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above described property as requested by the Havasu Heights Domestic Water Improvement District,
being represented by Steve Wilson, Chairman ofthe Board, Lake Havasu City, Arizona, and
WHEREAS, this property is located east and south of County Route 232, Heights Boulevard. The
site is accessed from Highway 95 via east on Heights Boulevard, then south on Rice Drive to Sierra Vista
Road, then south on Sierra Vista Road to Sky-View Drive, then south on Sky-View Drive to the Bureau of
Land Management (BLM) land in Section 18. The site is located approximately 2,000 feet south of the
intersection of Sky-View Drive and Coronado Road on BLM land. The property is vacant and has gently
rolling hills. The surrounding land uses consist of vacant BLM land and the Lake Havasu Heights
subdivision to the north. There are no significant drainage patterns that cross the property, dnd
WHEREAS, the applicant requests this Zoning Use Permit to allow a water storage tank for the
Havasu Heights Domestic Water Improvement District on 1.276 acres. The Mohave County General Plan
designates this area as a Rural Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-3000B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area. Do not obstruct any washes on the property, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b, The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 13, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is intended for a water storage tank for the Havasu Heights
Domestic Water Improvement District and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, December 17, 1995, and posted December 18,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, January 2, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
