A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE WYZ WYz OF SECTION
33, TOWNSHIP 41 NORTH, RANGE 15 WEST, FROM C-2 (GENERAL COMMERCIAL) ZONE
TO R-E (RESIDENTIAL-RECREATION) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
5, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by Scott D. and Nancy M. Jones, Keith D. and Theta F. Jones, Jimmy
L. and Sharon Jones, and Jay T. Jones of Roy, Utah, and
WHEREAS, this property is located north of Interstate 15 and west of U.S. Highway 91 in the
Beaver Dam area, approximately one mile north of the Interstate 15 and County Highway 91 interchange.
The site is accessed from Highway 91 via west on an Ingress and Egress (I&E) easement to the property.
The property is vacant. The terrain is sloping slightly toward the southwest. The surrounding land uses
consist of other residences to the north, vacant land to the east, a proposed recreational park to the south and
a mobile home park to the west. There are no significant drainage patterns that cross the property, and
WHEREAS, the applicant requests this zone change to allow occasional recreational use. The
Mohave County General Plan designates this area as a Rural Development Area and an outlying community,
and
WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, this item was previously heard at the December 13, 1995, Planning and Zoning
Commission meeting. Due to a staff oversight the property was not properly posted. The Commission had
recommended approval of this item by a vote of 7 to I with one member absent, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect on the property complies with the Mohave County
General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.

e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 10, 1996, the Commission recommended APPROVAL for a Rezone subject to the following:
I. This property will be rezoned R-E (Residential-Recreation).
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The applicant shall grant the 25 feet along the north boundary of this parcel to the public as
an Ingress & Egress and Public Utilities Easement (I&E and PUE).
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 5, 1996, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.

4. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any construction.
5. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
6. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title II, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, January 21, 1996, and posted January 19, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
